ARTIFICIAL INTELLIGENCE APPLIED TO PUBLIC ADMINISTRATIVE DECISIONS IN BRAZIL

Dissertação de Mestrado em Direito apresentada à Faculdade de DireitoThis dissertation deals with the application of artificial intelligence in the decision-making process of the Brazilian Public Administration, at the federal level. The objective is to identify how artificial intelligence can be employed in administrative decision making, as well as to analyze the legitimacy and challenges of the application of this tool. For this purpose, this study is divided into four parts. The first deals with the definition of artificial intelligence, presents historical aspects, lists the main models used in administrative decision-making and also the main technologies that constitute the ecosystem of artificial intelligence, with the aim of understanding the mechanisms involved. The second part deals specifically with the use of artificial intelligence in administrative decision making, the principles and rules that reflect on it, with the purpose of elucidating questions about its possible legitimacy to perform an administrative act, including addressing the impasses concerning its use, such as opacity, algorithmic discrimination, data protection and the State's civil liability. The third part portrays an overview of the standardization related to artificial intelligence in the world, notably regarding proposals from international institutions, such as OECD and UNESCO, as well as the main authors of this technology, the European Union, United States, China, United Kingdom and Japan, with the desideratum to reflect on the various standards to discuss the Brazilian system. The fourth part is constituted by the study of the effective and current application of artificial intelligence by the Brazilian Federal Public Administration, through the presentation of initiatives employed in various organs, to ponder the conceptions of projects and results. Thus, the research not only highlights the real potentiality of the use of artificial intelligence in administrative decision, but also discusses the inherent risks in this process to reflect on possible dogmatic legal solutions.A presente dissertação trata da aplicação da inteligência artificial no processo de decisão da Administração Pública brasileira, no âmbito federal. O objetivo é identificar como a inteligência artificial pode ser empregada na tomada da decisão administrativa, bem como analisar a legitimidade e os desafios da aplicação dessa ferramenta. Para tanto, o presente estudo está dividido em quatro partes. A primeira trata da definição da inteligência artificial, apresenta aspectos históricos, elenca os principais modelos utilizados na tomada da decisão administrativa e, também, as principais tecnologias que constituem o ecossistema da inteligência artificial, com o escopo de compreender os mecanismos envolvidos. A segunda parte versa especificamente sobre o uso da inteligência artificial na decisão administrativa, os princípios e as normas que refletem sobre ela, no propósito de elucidar questões sobre sua possível legitimidade para realizar um ato administrativo, inclusive abordando os impasses concernentes à sua utilização, como a opacidade, a discriminação algorítmica, a proteção de dados e a responsabilidade civil do Estado. A terceira parte retrata um panorama da normatização relativa à inteligência artificial no mundo, notadamente a respeito de propostas de instituições internacionais, como OCDE e UNESCO, como também dos principais autores dessa tecnologia, União Europeia, Estados Unidos, China, Reino Unido e Japão, com o desiderato de refletir sobre as diversas normas para discorrer sobre o sistema brasileiro. A quarta parte é constituída pelo estudo da aplicação efetiva e atual da inteligência artificial pela Administração Pública federal brasileira, mediante a apresentação de iniciativas empregadas em diversos órgãos, para ponderar as concepções dos projetos e resultados. Desse modo, a pesquisa evidencia a real potencialidade do uso da inteligência artificial na decisão administrativa, mas também debate os riscos inerentes a este processo para reflexão sobre possíveis soluções jurídicas dogmáticas
