Human Trafficking for sexual exploitation: women, especially vulnerable victims

Dissertação de Mestrado em Direito apresentada à Faculdade de DireitoThe aim of the present dissertation, to analyze the human trafficking, to analyze the phenomenon of trafficking in human beings, namely regarding women for the purpose of sexual exploitation, focusing on the possible reasons that lead them to become the main victims of the type under analysis. Therefore, it is necessary to present, initially, a contextualization of human trafficking, a transnational incrimination that displaces the borders of States. And, how can we place it in this new globalized contemporary world, marked by crises of all kinds, such as economic, political, social and climatic; as well as with the recession caused by the pandemic; problems caused by armed conflicts, such as forced migration, etc. These instabilities, which considerably increase the vulnerability of women, who live in the midst of risks and uncertainties regarding their security and freedom. Mister is done, to understand how the Portuguese legal system, harmonized with the international and community norms of the European Union, in the legal-criminal sphere deals with the confrontation of the crime under analysis, as well as to bring a study about the problem of vulnerability from the point of view of victimization. And, what are the main instruments of protection that the criminal legal system offers in response to the victim, in order to enforce their rights, provide security and their reintegration into society. In the end, we will briefly discuss the situation of vulnerability in Brazil, within the context of the crime of trafficking in persons.Pretende-se, no âmbito do desenvolvimento da presente dissertação, analisar o fenômeno tráfico de seres humanos, nomeadamente quanto as mulheres para finalidade de exploração sexual, focando nas possíveis razões que as levam a se tornarem as principais vítimas do tipo em análise. Para tanto, necessário se faz, apresentar, inicialmente, uma contextualização do tráfico de pessoas, uma incriminação transnacional que desloca as fronteiras dos Estados. E, como podemos situá-lo neste novo mundo contemporâneo globalizado, marcado por crises de toda ordem, tais como, econômicas, políticas, sociais e climáticas; bem como com a recessão causada pela pandemia; problemas causados conflitos armado, como a migração forçada, etc. Instabilidades estas, que aumentam consideravelmente a situação de vulnerabilidade da mulher, que vive em meio a riscos e incertezas quanto a sua segurança e liberdade. Mister se faz, compreender como o ordenamento jurídico português, harmonizado com as normativas internacionais e comunitárias da União Europeia, na esfera jurídico-criminal trata do enfrentamento do crime em análise, assim como trazer um estudo acerca da problemática da vulnerabilidade sob o ponto de vista da vitimização. E, quais os principais instrumentos de proteção que o sistema jurídico-criminal oferece em resposta para a vítima, de modo a efetivar seus direitos, conferir segurança e sua reintegração à sociedade. Ao final, brevemente, discorreremos acerca da situação de vulnerabilidade no Brasil, dentro do contexto do crime de tráfico de pessoas
