PENERAPAN RESTORATIVE JUSTICE SEBAGAI ALTERNATIF PENYELESAIAN PERKARA DALAM TINDAK PIDANA RINGAN (Studi Pada Polres Kota Batu)

One of the classifications put forward by the expert, namely crimes that are classified as minor crimes such as minor theft, are included in the classification of criminal acts that must be handled according to the principle of restorative justice. The purpose of this research is the first, to find out the application of the principle of restorative justice in the settlement of minor criminal cases at the Batu City Police. Second, to find out the inhibiting factors in the application of the principle of restorative justice in the settlement of minor criminal cases at the Batu City Police. The research method used is sociological juridical, interview data collection method and literature study, qualitative descriptive data analysis. The results showed that first, the application of the principle of restorative justice in the settlement of minor criminal cases at the Batu City Police was in accordance with the formal and material requirements as stipulated in PERPOL, namely by conducting a case title, then stopping the case or implementing the results of the restorative justice. by issuing a decree to terminate the investigation or investigation. However, the application of restorative justice in minor criminal cases at the Batu Police is still not widely applied as a substitute for the implementation of minor criminal cases at the Batu Police as a whole. Obstacles of the Batu Police Satreskrim investigators in applying the principles of restorative justice include: the absence of regulations that regulate the implementation of restorative justice, the difficulty of both parties to reconcile, the perpetrators are not willing to compensate for the losses suffered by the victims, Lack of Public Knowledge About Restorative Justice Efforts, the difficulty the victim's party to find evidence, and the difficulty of bringing the litigants together
