PENEGAKAN HUKUM YANG DILAKUKAN OLEH PIHAK KEPOLISIAN TERHADAP PENGEMUDI YANG MENGGUNAKAN PONSEL PADA SAAT MENGENDARAI KENDARAAN BERMOTOR DI JALAN RAYA KOTA BATU ( studi kasus di wilayah hukum kota batu)

In Batu City, there are still many drivers who drive unnaturally, such as using cellphones when driving on the highway. In fact, according to a study conducted by the Governors Highway Safety Association (GHSA) in the United States, that using cell phones, including calling and texting, is one of the biggest causes of road accidents. In this case, the actions of drivers who use cellphones while driving, violate the provisions contained in Law Number 22 of 2009 concerning Road Traffic and Transportation. The purpose of this study is to examine the role of the Batu City Police in enforcing the law against motorists who use cell phones which result in impaired concentration in driving, as well as to examine the obstacles in tackling motorists who use cell phones that cause impaired concentration in driving in Batu City. The method used in this research is empirical legal research by conducting studies in the form of observations and literature studies. The results of the study indicate that the law enforcement against motorists who use cellphones while driving by the Batu City Resort Police is still not optimal. However, the Batu City Police Resort continues to seek enforcement of the rules by conducting outreach to the public, besides that the police have developed a ticket using an electronic ticket. Meanwhile, the obstacle in tackling motorists who use mobile phones is the behavior of motorists who think more about their own interests and do not think about the safety of themselves and other road users
