The protected status of members of the National Police under International Humanitarian Law (IHL) in the Colombian armed conflict has persisted in a “gray zone” both normatively and jurisprudentially. In its judgement, TP-SA-AM 168 of 2020, the Appeals Section of the Tribunal for Peace of the Special Jurisdiction for Peace comprehensively defined the controversy and specified the scope of such protected status. While, in principle, the proposed solution in the decision appears to abide by with the norms of IHL, the use of continuous combat function as a criterion for determining de facto incorporation into the Armed Forces, and the exceptions provided to such incorporation, seem to deviate from the normative framework of IHL.
