Caducidad de la instancia atribuible a las partes en el derecho civil mexicano: un obstáculo para el acceso a la justicia

The main objective of this research was to identify the essential characteristics that update the expiration of the instance in civil matters and how  the right of access to justice is affected by this procedural feature. The research is based on a descriptive qualitative documentary methodology. 1 article of the Federal Code of Civil Procedures, 2 articles of the Code of Civil Procedures for the State of Tabasco, 1 isolated thesis and 5 jurisprudence of the Supreme Court of Justice of the Nation, 2 articles of the Federal Constitution and 1 article of the American Convention on Human Rights, were selected to determine the obligation of the legal operators to promote ex officio procedures, when the parties refrain from presenting motions and thus prevent the expiration of the instance from being updated, a measure that guarantees effective judicial protection and exact compliance with the pro persona principle, thus providing the person with the greatest protection. The most relevant results of the investigation determine that article 373 section IV of the Code Federal of Civil Procedures, violates the right to effective judicial protection, access to justice and judicial protection, therefore this standard prevents judges from imparting justice promptly and without obstaclesLa presente investigación tuvo como objetivo principal identificar las características esenciales que actualizan la caducidad de la instancia en materia civil y el como esta figura procesal afecta el derecho de acceso a la justicia. La investigación está basada en una metodología documental de tipo cualitativa descriptiva. Se seleccionó 1 artículo del Código Federal de Procedimientos Civiles, 2 artículos del Código de Procedimientos Civiles para el Estado de Tabasco, 1 tesis aislada y 5 jurisprudencias de la Suprema Corte de Justicia de la Nación, 2 artículos de la Constitución Federal y 1 artículo de la Convención Americana Sobre Derechos Humanos, para determinar la obligación de los operadores jurídicos para impulsar de oficio los procedimientos,  cuando las partes se abstienen de presentar promociones y así evitar que se actualice la caducidad de la instancia, medida que garantiza la tutela judicial efectiva y el cumplimiento exacto del principio pro homine, dando así la mayor protección a la persona. Los resultados más relevantes de la investigación determinan que el artículo 373 fracción IV del Código Federal de Procedimientos Civiles, vulnera el derecho a una tutela judicial efectiva, el acceso a la justicia y la protección judicial, por lo que esta norma impide al juzgador impartir justicia pronta y sin obstáculos
