DIREITO EM GRAMSCI

This article examines relationships among democracy, hegemony andthe law as a component of the superstructure, in face of an analysis of the philosophyof the praxis. Through a study of Gramsci’s texts, the author opposespublic and private, collective and individual, in the history of the incorporation ofRoman Law and elicits reflections on the theme of the modern State coincidingwith the liberal conception of law.Cet article analyse les rapports entre démocracie, hégémonie et la loi entant qu’élément de la superstructure, face a la philosophie de la praxis. Se basantsur 1'étude des textes de Gramsci, I’auteur oppose public et privé, collectifet individuel, dans I’histoire de I’incorporation du Droit Romain, et suscite le thèmede I'Etat moderne en ce qu’il coincide avec la conception libérale de Ia loi.Este artigo examina as relações, nos escritos de Gramsci, entre democracia,hegemonia e o direito como componente da superestrutura, colocando-oem face da filosofia da praxis.
