La vulneración del derecho a recurrir en las contravenciones cometidas por adolescentes infractores

The general objective of the research was to legally analyze the violation of the right of recourse in contraventions committed by adolescent offenders. It was carried out from the quantitative paradigm, working with a documentary descriptive methodology with a bibliographic design, allowing to investigate in bibliographic and legal sources, articulating a theoretical reflective body as a contribution to strengthening the legal-theoretical basis of law, the technique of content analysis as a strategy to scrutinize the original message in a reasoned interpretation of the researcher, incorporating the generation of new proposals of logical and coherent support on the object of study. It is concluded that the right to appeal constitutes a guarantee of defense that supports the double conformity; it is a right recognized in international human rights instruments and in the Constitution of the Republic of Ecuador, therefore, this right of direct and immediate application and prevails over any other of the legal system.El objetivo general de la investigación fue analizar jurídicamente la vulneración del derecho a recurrir en las contravenciones cometidas por adolescentes infractores. Se realizó desde el paradigma cuantitativo, se trabajó con metodología de tipo descriptiva documental con un diseño bibliográfico, permitiendo indagar en fuentes bibliográficas y jurídicas, articulando un cuerpo reflexivo teórico como contribución al fortalecimiento del basamento teórico-jurídico del derecho, la técnica del análisis de contenido como estrategia para escudriñar el mensaje original en una interpretación razonada del investigador, incorporando a la generación de nuevas propuestas de sustento lógico y coherente sobre el objeto de estudio. Se concluye que, el derecho a recurrir constituye una garantía de defensa que avala el doble conforme; es un derecho reconocido en instrumentos internacionales de derechos humanos y en la Constitución de la República del Ecuador, por ende, este derecho de aplicación directa e inmediata y prevalece ante cualquier otra del ordenamiento jurídico
