QUALIFICADORA DO FEMINICÍDIO E SUA APLICABILIDADE NOS CASOS DE MORTE E VIOLÊNCIA ENVOLVENDO MULHERES TRANSGÊNEROS

This article delimits itself in the analysis of femicide in the face of transsexual female victims, having as its starting point the following problem: does femicide apply in cases of death and violence involving transgender women as victims? To answer it, the general objective was to analyze the possibility of applying femicide to transsexual victims. The study was justified by the growing number of murders of transsexuals, which even made Brazil, in 2020, the country with the highest number of murders of trans people in the world, mostly motivated by hate speech to gender identity. As a method, an exploratory and qualitative research was adopted, carried out through the literature review, also using the deductive method. Collecting the collection and analysis of data, it was found that, despite the differences on the subject and, given the existence of three criteria for recognition of the victim of femicide, because gender identity is a fundamental right, it should be applied the psychological criterion for defining the victim of the criminal type. This led to the conclusion that the qualifier of femicide applies to crimes committed against female transsexuals.O presente artigo delimita-se na análise do feminicídio em face de vítimas transexuais femininas, tendo como ponto de partida o seguinte problema: o feminicídio tem aplicabilidade nos casos de morte e violência envolvendo mulheres transgêneros como vítimas? Para respondê-lo, o objetivo geral consistiu na análise da possibilidade de aplicação do feminicídio para vítimas transexuais. Justificou-se o estudo pelo crescente número de assassinatos de transexuais, o que, inclusive, fez do Brasil, em 2020, o país com maior número de homicídios de pessoas trans no mundo todo, a maioria motivados por discurso de ódio à identidade de gênero. Como método, adotou-se a pesquisa exploratória e qualitativa, realizada através de revisão de literatura, empregando-se, também, o método dedutivo. Após a coleta e análise dos dados, verificou-se que, apesar das divergências sobre o tema e, diante da existência de três critérios de reconhecimento da vítima do feminicídio, pela identidade de gênero tratar-se de um direito fundamental, deve-se aplicar o critério psicológico para definição do sujeito vítima do tipo penal. Isto fez concluir que a qualificadora do feminicídio aplica-se nos crimes cometidos em face das transexuais femininas
