ESTUPRO MARITAL NO CONTEXTO DA LEI MARIA DA PENHA: ANÁLISE DOS DADOS COLETADOS NA DELEGACIA DE POLICIA CIVIL DE MARAVILHA/SC

The objective of this article was to address rape in the context of marriage, known as marital rape, which is characterized as sexual violences practiced by the husband with the wife within their homes. It was sought to analyze the history of feminine submission presented by the patriarchy and adopted as a woman’s duty in marriage, as well as the history of rape and its judicial evolution. Finally, a study on the Maria da Penha law and the National Risk Assessment Form, imposed by Law n. 14.149/21, was done. Also, data in relation to protective measures and question four of the form above mentioned collected from the Civil Police Station of Maravilha was analyzed. It was concluded that even though legislation typifies sexual violence practiced by the husband, there are few women who report this practice due to the belief that it is their duty and out of shame in regard’s to society’s judgement.O objetivo deste artigo foi abordar o estupro no âmbito do matrimônio, conhecido como estupro marital, o qual é caracterizado pela violência sexual praticada pelo marido com a esposa na mudez de seus lares. Buscou-se analisar o histórico da submissão feminina apresentado pelo patriarcado e adotado como dever da mulher no casamento, também a historicidade do estupro e sua evolução jurídica. Por fim, realizou-se um estudo sobre a Lei Maria da Penha e o Formulário Nacional de Avaliação de Risco, instituído pela Lei n. 14.149/21, e analisou-se os dados coletados da Delegacia de Polícia Civil de Maravilha com relação as Medidas Protetivas e a pergunta número 4 do formulário mencionado. Conclui-se que apesar das legislações tipificarem a violência sexual praticada pelo marido, poucas são as mulheres que denunciam essa prática, por acreditar ser esse seu dever e por vergonha dos julgamentos da sociedade
