O DIREITO AO ESQUECIMENTO EM RISCO NA SOCIEDADE DA INFORMAÇÃO

This work aims to analyze the applicability of the right to be forgotten in the information society, since it is inserted as an instrument of protection to the rights of the personality conferred to the human person. Through bibliographic research and case studies, it aims to analyze the fundamentals of the right to be forgotten, which has already been appreciated by the Superior Courts in cases involving past facts of the person's life and their exposure on television and internet. This situation is aggravated in the information society, which is marked by the constant and rapid sharing of news and information, which often invades the private sphere of individuals. Although it is possible to identify the right to be forgotten in the Brazilian legal system, its discussion is still limited. For this reason, the method to resolve such conflict starts from doctrine and jurisprudence, elucidating weighting techniques, in order to reach a fair solution, depending on each specific case. It turns out, from the study carried out, that the right to be forgotten is an instrument of overweight in jurisdictional innovation, but is put at risk in the information society, since the information about the person posted in the media, notably on the internet, are at risk of staying there forever, violating human personality rights.Este trabalho tem como objetivo analisar a aplicabilidade do direito ao esquecimento na sociedade da informação, uma vez que se insere como instrumento de proteção aos direitos da personalidade conferidos à pessoa humana. Por meio de pesquisa bibliográfica e estudos de caso, objetiva analisar os fundamentos do direito ao esquecimento, que já foi apreciado pelos Tribunais Superiores em casos envolvendo fatos passados da vida da pessoa e sua exposição na televisão e internet. Essa situação é agravada na sociedade da informação, que é marcada pelo constante e rápido compartilhamento de notícias e informações, que, muitas vezes, invadem a esfera privada dos indivíduos. Ainda que seja possível identificar o direito ao esquecimento no ordenamento jurídico brasileiro, sua discussão ainda é limitada. Por isso, o método para solucionar tal conflito parte da doutrina e jurisprudência, elucidando técnicas de ponderação, de modo a alcançar uma solução justa, a depender de cada caso concreto.  Constata-se, a partir do estudo realizado, que o direito ao esquecimento é um instrumento de sobrepeso na inovação jurisdicional, mas é posto em risco na sociedade da informação, uma vez que as informações referentes à pessoa lançadas nos meios de comunicação, notadamente na internet, correm o risco de lá permanecerem eternamente, violando direitos da personalidade humana
