A (IM)POSSIBILIDADE DA APLICAÇÃO DE DESÁGIO SOBRE OS CRÉDITOS TRABALHISTAS NO PROCESSO DE RECUPERAÇÃO JUDICIAL

The present study objective to analyze the possibility or not of the application of discount on labor credits, in the judicial recovery process. This is because, considering the legal provisions and the principles that guarantee the labor law, eventually it is necessary to talk about the impossibility of applying the discount on labor credits, since some labor credits have a salary nature and are constitutionally protected from wage reductions. On the other hand, cannot forget the principle of sovereignty of the General Meeting of Creditors, and the imperious nature of the recovery of the company, based on the social function of the company, also provided for in the Federal Constitution of the Brazilian Republic. This research has a bibliographic character, will be exploratory descriptive and based on interpretative techniques. The scientific method used will be the deductive one, and will conclude by the (im) possibility of applying negative goodwill on labor credits in the judicial reorganization process.O presente estudo tem por objetivo analisar a possibilidade ou não da aplicação de deságio sobre os créditos trabalhistas no processo de recuperação judicial. Isso porque, se considerados os dispositivos legais e os princípios que guarnecem o direito do trabalho, eventualmente há de se falar na impossibilidade quanto à aplicação do deságio sobre as verbas trabalhistas, uma vez que, algumas verbas trabalhistas, possuem natureza salarial e são protegidas pela irredutibilidade salarial, prevista na Constituição. Por outro lado, não se pode olvidar do princípio da soberania da Assembleia Geral de Credores, e a imperiosidade do soerguimento da empresa que tem por base a função social da empresa, prevista também na Constituição Federal da República Brasileira. A presente pesquisa tem caráter bibliográfico, será descritiva exploratória e baseada em técnicas interpretativas. O método científico utilizado será o dedutivo, e a concluirá pela (im) possibilidade de aplicação de deságio sobre os créditos trabalhistas no processo de recuperação judicial
