RESISTÊNCIA NA EFETIVAÇÃO DOS DIREITOS DAS PESSOAS COM DEFICIÊNCIA SOB A ÓTICA DA ECONOMIA

It is proposed to investigate the problem that involves resistance in effectuation the rights of people with disabilities from the perspective of the economy. The objective was to identify how the economy has impacted as a resistance factor for the realization of the fundamental rights of people with disabilities. Theoretical and explanatory research and bibliographic, legal and jurisprudential research method were used to understand the relevant aspects of the main legal provisions for the protection of people with disabilities and their social impacts. It was observed that lawful prediction of a mandatory nature constantly used general concepts of reasonableness and proportionality and that economic factors are intrinsically linked to the guarantee of Human Dignity, whether in the sense of ensure the minimum conditions of subsistence for people with disabilities whether while ground of excuse for non-inclusion.Keywords: disabled person; economy; fundamental rights.  Propõe-se investigar a problemática que envolve a resistência na efetivação dos direitos das pessoas com deficiência sob a ótica da economia. Objetivou-se identificar como a economia tem impactado como fator de resistência da efetivação dos direitos fundamentais das pessoas com deficiência. Utilizou-se da pesquisa teórica e explicativa e método de pesquisa bibliográfico, legal e jurisprudencial para compreender os aspectos relevantes das principais disposições legais de proteção das pessoas com deficiência e seus reflexos sociais. Observou-se que as previsões legais com natureza obrigatória utilizaram constantemente de conceitos gerais de razoabilidade e proporcionalidade e que os fatores econômicos estão intrinsecamente ligados à garantia da Dignidade Humana, seja no sentido de garantir as condições mínimas de subsistência para as pessoas com deficiência seja enquanto fundamento de escusa de não inclusão.
