A POSSIBILIDADE DE CONFIGURAÇÃO DO ACORDO DE NÃO PERSECUÇÃO PENAL NO MODELO DE BARGANHA NORTE-AMERICANO

This article analyzes the institutes of plea bargaing and the non-criminal prosecution agreement, exposing about the possibility of configuring the criminal agreement model implemented in Brazil in that one that exists in the United States. To do so, it uses the bibliographic, qualitative, exploratory and deductive method in conducting the proposed research. In the first topic, it deals with the emergence of plea bargaining in the United States, how the institute is approached in criminal proceedings, its definition and main characteristics. Furthermore, it points out a critical opinion about the North American bargain. The second topic, deals with the non-criminal prosecution agreement, with its legal provision, concept and main features. Then, it jointly analyzes the characteristics of each institute and concludes that it is not possible to configure the non-criminal prosecution agreement in the North American bargaining model, due, essentially, to the penal character displayed by the plea bargaining in the United States.O presente artigo analisa os institutos do plea bargaing e do acordo de não persecução penal, expondo acerca da possibilidade de configuração do modelo de acordo criminal implementado no Brasil naquele existe nos Estados Unidos. Para tanto, utiliza o método bibliográfico, qualitativo, exploratório e dedutivo na realização da pesquisa proposta. No primeiro tópico, dispõe a respeito do surgimento do plea bargaining nos Estados Unidos, como o instituto é abordado no procedimento criminal, sua definição e principais características. Além disso, aponta uma opinião crítica acerca da barganha norte-americana. No segundo tópico, trata sobre o acordo de não persecução penal, trazendo sua previsão legal, conceito e principais traços. Na sequência, analisa conjuntamente as características de cada instituto e conclui que não é possível a configuração do acordo de não persecução penal no modelo de barganha norte-americano, em razão, essencialmente, do caráter penalizador ostentado pelo plea bargaining dos Estados Unidos
