TRIBUTAÇÃO MUNICIPAL COMO INSTRUMENTO DE EFETIVIDADE AO PRINCÍPIO DO MEIO AMBIENTE ECOLOGICAMENTE EQUILIBRADO

Introduction: It is known that in the contemporary stage the humanity lives with a dramatic environmental crisis, whose effects reflect difficulties across the globe, providing the irrefutable global warming, perishing of flora and fauna specimens, among many other regrettable episodes. International public policies are proving unsatisfactory to curb objectionable human actions, and much more ineffective in helping environmental recovery programs. Therefore, before the various political and legal instruments for environmental preservation, tax extrafiscality stands out as an auxiliary mechanism for the preservation and recovery of the Brazilian environment. Objective: Consequently, this research aims to analyze the legal and tax mechanisms that can be used by the municipal tax administration as an instrument to mitigate environmental impacts in Brazil. Method: In this sense, first, the deductive method was applied to understand the dogmatic and structuring peculiarities of the Brazilian National Tax System, in particular: the tax competences related to the Municipalities. Next, the phenomenon of environmental taxation was analyzed, as well as its institutional limits and the pragmatic consequences of this type of exaction. Still, the comparative method was used to indicate its implementation in the municipalities. Results: In fact, the following assumptions were found: (I) Considering all tax competences, among the taxes that may have an environmental extrafiscal nature, the following stand out: Import Tax; Export Tax; Income tax; Tax on Industrialized Product; Tax on Rural Territorial Property; Tax on Circulation of Goods and Services;  Vehicle Ownership Tax; Territorial and Urban Property Tax; Tax on Services of Any Nature, Fee for the Exercise of Police Power; and Compulsory Loan; (II) The Polluter Pays Principle in the tax sphere can only be applied when the Federal Constitution expressly authorizes it, under penalty of conceptual subversion of the tax defined in the Brazilian National Tax Code; (III) Compared to other federative entities, the Brazilian municipalities lack sufficient tax competence to curb, transform and reverse the national environmental framework, with the urgent need for a tax reform; (IV) The progressive IPTU (Territorial and Urban Property Tax) due to the social function of the property is the main and most impactful instrument of municipal environmental taxation. Conclusion: In view of the results of this research, municipal environmental taxation, when rationally employed, considering the principle of subsidiarity and the role of the municipality as a transforming agent, can serve as a healthy aid mechanism to promote the principle of the environment ecologically balanced.Keywords: Tax Law. Municipal Tax Administration.Introducción: Se sabe que en la etapa contemporánea la humanidad vive una dramática crisis ambiental, cuyos efectos reflejan dificultades en todo el mundo, ante el irrefutable calentamiento global, la desaparición de especímenes de flora y fauna, entre muchos otros episodios lamentables. Las políticas públicas internacionales están resultando insatisfactorias para frenar las acciones humanas objetables y mucho más ineficaces para ayudar a los programas de recuperación ambiental. Por lo tanto, considerando los diversos instrumentos políticos y legales para la preservación ambiental, la extrafiscalidad de la actividad tributaria se destaca como un mecanismo auxiliar para la preservación y recuperación del medio ambiente brasileño. Objetivo: Esta investigación tiene como objetivo analizar los mecanismos jurídico-tributarios que pueden ser utilizados por la administración tributaria municipal como instrumento para mitigar los impactos ambientales en Brasil. Método: En este sentido, en primer lugar, se aplicó el método deductivo para comprender las peculiaridades dogmáticas y estructurantes del Sistema Tributario Nacional Brasileño, en particular: las competencias tributarias relacionadas con los Municipios. A continuación, se analizó el fenómeno de la tributación ambiental, así como sus límites institucionales y las consecuencias pragmáticas de este tipo de exacciones. Aun así, se utilizó el método comparativo, con el fin de indicar su implementación en los municipios. Resultados: De hecho, se encontraron los siguientes supuestos: (I) Considerando todas las competencias tributarias, entre los impuestos que pueden tener carácter ambiental extrafiscal, se destacan los siguientes: Impuesto de Importación; Impuesto a la Exportación; Impuesto de Renta; Impuesto Sobre Producto Industrializado; Impuesto a la Propiedad Territorial Rural; Impuesto Sobre Circulación de Bienes y Servicios; Impuesto Sobre la Propiedad de Vehículos; Impuesto sobre la Propiedad Urbana; Impuesto sobre Servicios de Cualquier Naturaleza, Tasa por el Ejercicio del Poder de Policía; y el Préstamo Obligatorio; (II) El principio de quien contamina paga en el ámbito tributario sólo podrá aplicarse cuando la Constitución Federal lo autorice expresamente, bajo pena de subversión conceptual de la naturaleza tributaria definida en el Código Tributario Nacional; (III) En comparación con otras entidades federativas, los municipios carecen de competencia tributaria suficiente para frenar, transformar y revertir la situación ambiental nacional, con la urgente necesidad de una reforma tributaria; (IV) El IPTU (Impuesto sobre la Propiedad Urbana) progresivo por función social de la propiedad es el principal y más impactante instrumento de la tributación ambiental municipal. Conclusión: A la vista de los resultados de esta investigación, es claro que la tributación ambiental municipal, cuando se emplea racionalmente, teniendo en cuenta el principio de subsidiariedad y la función del municipio como agente transformador, puede servir como un mecanismo de ayuda para promover el principio del medio ambiente ecológicamente equilibrado.Palabras clave: Derecho Tributario.
