Pentingnya Kepemilikan Sertifikat Tanah Melalui Pendaftaran Tanah Sebagai Bukti Hak

This study aims to find out and analyze how the process of certifying state land into land rights and what obstacles are faced in certifying state land into land rights to land use using normative juridical research methods. The results of the study explained that certifying the land and reversing the name of the land in the name of the certificate owner is an important thing for the community to do to avoid legal problems or minimize risks in the future. With the issuance of a certificate of land rights, the owner is given legal certainty and legal protection to prevent legal disputes that occur in the future as a result of parties who feel aggrieved because of the issuance of a land certificate. One of the land problems that often arises in the community is land disputes or land struggles between parties. One way that can be used to minimize land disputes that occur both between communities and communities with the government is to enforce legal regulations, in the form of clear laws in order to provide legal certainty to the legal owners of land rights, and also laws that are coercive and regulate in order to create order in society. The existence of land registration as proof of rights is legal proof of land ownership. Apart from being proof of ownership, the legality aspect is also to provide certainty to the parties that there is a legal owner of the land.Penelitian ini bertujuan untuk mengetahui dan menganalisis bagaimana proses pensertifikatan tanah negara menjadi tanah hak dan apa kendala yang dihadapi dalam melakukan pensertifikatan tanah negara menjadi tanah hak terhadap pemanfaatan tanah yang dengan menggunakan metode penelitian yuridis normatif. Adapun hasil penelitian menjelaskan bahwa pensertifikatan tanah dan membalik nama tanahnya atas nama pemilik sertifikat adalah hal yang penting dilakukan masyarakat agar terhindar dari permasalahan hukum atau meminimalisir resiko dikemudian hari. Diterbitkannya sertifikat hak atas tanah, maka kepada pemiliknya diberikan kepastian hukum dan perlindungan hukum untuk mencegah adanya sengketa gugatan hukum yang terjadi dikemudian hari akibat dari adanya pihak yang merasa dirugikan karena terbitnya suatu sertifikat tanah. Salah satu permasalahan tanah yang sering muncul dalam masyarakat yakni sengketa tanah atau perebutan tanah antar pihak. Adapun salah satu cara yang dapat digunakan untuk meminimalisir sengketa tanah yang terjadi baik antar masyarakat ataupun masyarakat dengan pemerintah ialah dengan menegakkan peraturan hukum, berupa hukum yang jelas agar dapat memberikan kepastian hukum kepada pemilik sah hak atas tanah tersebut, dan juga hukum yang bersifat memaksa dan mengatur guna terciptanya ketertiban dalam masyarakat. Pendaftaran tanah sebagai bukti hak merupakan bukti legal kepemilikan tanah. Selain sebagai bukti kepemilikan, aspek legalitas juga untuk memberikan kepastian kepada para pihak bahwa ada pemilik yang sah atas tanah tersebut.
