EKSISTENSI DAN FUNGSI NASKAH AKADEMIK PEMBENTUKAN PERATURAN PERUNDANG-UNDANGAN

As a legal state, Indonesia uses laws as instruments in carrying out legal policies. Of course, in the formation of statutory regulations, one must pay attention to the principles of forming good laws and regulations, one of which starts with the draft of an academic text. This research is a normative legal research. The approach used in this research is a historical and conceptual approach. The results of this study indicate that the existence of academic texts in its history only existed. The term academic text emerged as a legal text in the 2000s. Definition of an academic text can be seen at the Presidential Regulation No. 68 of 2005 on Procedures for Preparing a bill after the revocation of Law No. 10 of 2004 on the Establishment Regulation Legislation with Law Number 12 of 2011 concerning the legislation, the existence of an academic text clearer. This can be seen in Article 43 paragraph (3) of Law Number 12 of 2011 "A draft law originating from the DPR, the President, or the DPD must be accompanied by an academic document. While the function of academic texts in the formation of laws and regulations in order to establish good laws and regulations is that academic texts as a basic guideline for the formation of laws and regulations are not only seen in a formalistic way, but must be viewed from sociological and philosophical aspects. In addition, the academic text is also a benchmark so that the legislators do not go too far at the time of their formation and discussion before being ratified into law.
