Valorização e exploração do património vinculado em São Miguel (séculos XVII-XVIII)

In the long run, that is, when we consider the process of property entailment in the Azores from the late 15th century to the eve of the Liberal Revolution, we can see that regarding the most important houses in the island of São Miguel, among which stood out several from the city of Ponta Delgada, there was an accumulation of institutions, as a result of endogamous and blood marital alliances and the extinction of some masculine lineages. This progressive leeway eventually favoured towards the end of the Ancien Régime the noblest houses of Ponta Delgada, which therefore stood out among local nobility as the foremost entailed houses. Despite the constant criticism that, mainly from the mid-18th century onwards, was thrown at the entailment system, deemed responsible for the inactivity of farm units and the inexistent development of agricultural techniques, not all of those who instituted or administered entails neglected the impact entailment had on properties devoted thereto. Others, however, as they tried to keep their accounts in order, failed to ensure the income necessary to fulfil what was set forth in the founding document and some heads of entailed houses had to face seizures, as a result of a less careful management. In this text we offer some elements regarding the entailment administration in São Miguel and we comment on model cases that serve as an introduction to the inner workings of the entailment administration and to the legal mazes in which all parties involved in endless litigations moved.Na longa duração, isto é, quando consideramos o processo de vinculação da propriedade nos Açores desde finais de Quatrocentos até às vésperas da Revolução Liberal, constatamos que, ao nível das casas principais da ilha de São Miguel, entre as quais avultavam várias da cidade de Ponta Delgada, ocorreu uma acumulação de instituições, consequência das alianças matrimoniais endogâmicas e consanguíneas e da extinção de certas linhas masculinas. Esta deriva progressiva acabou por beneficiar, no final do Antigo Regime, as casas da melhor nobreza de Ponta Delgada, que se destacavam, assim, de entre o corpo nobiliárquico micaelense como as principais casas vinculares. Ora, não obstante as críticas insistentes que, sobretudo a partir de meados do século XVIII, foram dirigidas contra o regime vincular, considerado como responsável pela inércia das explorações e pelo nulo desenvolvimento das técnicas agrícolas, nem todos os instituidores ou administradores de vínculos se alhearam do impacto da vinculação sobre os bens fundiários que destinaram a esse fim. Outros, porém, embora tenham procurado manter as contas em ordem, não conseguiram assegurar o rendimento necessário para o cumprimento do disposto no documento fundador e alguns cabeças de casas vinculares tiveram de enfrentar o confisco de bens, fruto de uma gestão menos cuidada. Neste texto, apresentamos alguns elementos relativos à administração vincular em São Miguel e comentamos casos exemplares que nos servem de introdução aos meandros da administração vincular e aos labirintos legais em que se moviam as partes, envolvidas em intermináveis pleitos judiciais
