El control de convencionalidad: ¿Un punto de llegada o un camino interpretativo? Una reflexión sobre los alcances de la doctrina de la Corte Interamericana de Derechos Humanos

The doctrine of conventionality control has proven controversial from its very beginnings, and has both supporters and detractors, who have ventured into a dispute that does not seem to end. In this work, we do not intend to take sides for or against the legitimacy of conventionality control, but rather to ask a specific question about the scope that such doctrine has or that it could have. Since the creation of the doctrine, the Inter-American Court of Human Rights has been shaping various aspects of the doctrine and it could be argued that progress has been made towards its expansion. However, the Court has not yet dealt with the following question, which we wish to tackle here: should we understand that conventionality control includes only the obligation to apply the standards that arise from the text of the Convention plus the interpretations of the Court, or does it also involve the duty to adopt the way in which they are to be applied? In other words, we are interested in exploring whether, in the current situation or through future developments, this control could be understood to comprise not only interpretive results but also the adoption of certain hermeneutical guidelines.La doctrina del control de convencionalidad ha sido controvertida desde sus inicios y cuenta con simpatizantes y detractores que se han aventurado en una disputa que parece no acabar. En este trabajo no pretendemos tomar posición a favor o en contra de la legitimidad del control de convencionalidad, sino hacernos una pregunta específica sobre los alcances −que tiene o podría tener− dicho control. Desde su creación, la Corte Interamericana de Derechos Humanos ha ido delineando diversos aspectos de la doctrina y podría sostenerse que ha avanzado de cara a su expansión. Sin embargo, no se ha expedido aún sobre el siguiente interrogante que deseamos plantear aquí: ¿debe entenderse que el control de convencionalidad contempla solo la obligación de aplicar los estándares que surgen del texto de la Convención y las interpretaciones que de ella haga la Corte, o también involucra el deber de adoptar el modo en el que se ha de aplicar? En otras palabras, nos interesa explorar si, en el estado actual de cosas o mediante futuros desarrollos, podría entenderse que este control comprende no solo el resultado interpretativo sino también la adopción de ciertas pautas hermenéuticas
