L'INFLUENZA DELLA DOTTRINA SULLA GIURISPRUDENZA NELLA COMUNICAZIONE TRANSNAZIONALE

This paper sets out to look at the ways doctrinal and jurisprudential models effectively flow and communicate with each other within the “communicating world”. On the one hand, the seemingly apparent court prohibition set on express reference to a set of doctrines seems to lie behind the legal mindset of comparative lawyers and becomes only marginally relevant. On the other, however, the likely impact of legal doctrine on jurisprudence may be measured against varying standards which not only pertain to the legal sources and the ways these are ranked one above another and methodologically constructed and interpreted, but also significantly bear upon the style that is mutually taken by judgments and other such literary forms within and across diverse comparative legal systems and experiences. Viewed from this increasingly transnational perspective, any research work done by comparative civil lawyers can only fulfil two main functions. Firstly, albeit not exclusively, such a function can be met as long as it unconsciously becomes the mediated source of legal transplants themselves. Yet, any such «dialectical or problematic use» of comparative legal research must always provide judges with appropriate models for legal reasoning alongside topics and ideas for use in the quest for legal solutions. Secondly, though more essential and exclusive in nature, such a function is concerned with the tools for controlling and verifying the processes behind “comparative” topics. While being properly employed, these topics constantly need to be “contextualized” through a process of comparison which involves the nascent and recipient system of law, both at the historical and systematic levels of inquiry. The fact that Italian courts are now increasingly turning to data and information for aid to comparative work rather than simply to systematic comparison makes it relevant for this author to distinctively examine some of the most significant assumptions made in current literature, with a view to verifying the syntactic appropriacy of legal transplants and the cogency as well as the “systematic” coherence of solutions found on the basis of historical and morphological peculiarities surrounding individual systems of law. Se, da un lato, il divieto apparente delle Corti di citare esplicitamente la dottrina appare come un crittotipo che è del tutto marginale nel panorama planetario, dall’altro, l’impatto della dottrina sulla giurisprudenza può essere misurato sulla base di una serie di varianti che riguardano non soltanto le fonti, la loro gerarchia e i metodi interpretativi, ma anche lo stile che le sentenze e le varie forme letterarie assumono, reciprocamente, nelle diverse esperienze giuridiche. In questo contesto sempre più trans-nazionale l’opera del civil-comparatista realizza quanto meno due diverse funzioni. La prima, non esclusiva, è assolta allorché diviene, inconsapevolmente, la fonte mediata del trapianto. Ma un «uso dialettico o problematico» della comparazione deve saper offrire al giudice modelli di ragionamento giuridico, argomenti e idee da utilizzare nella ricerca della soluzione giuridica. La seconda funzione, più essenziale ed esclusiva, riguarda il controllo e la verifica dell’argomento “comparativo” il quale, anche se correttamente utilizzato, deve essere sempre “contestualizzato” mediante un raffronto che involge, sul piano storico e sistematico, l’ordinamento d’origine e quello recipiente. Proprio il crescente ricorso, da parte delle nostre Corti, all’informazione comparativa più che alla comparazione sistematica, induce l’autore ad esaminare partitamente alcune ipotesi maggiormente significative, allo scopo di verificare la correttezza sintattica del trapianto, il rigore e la coerenza “sistematica” delle soluzioni, sulla base delle caratteristiche storiche e morfologiche che caratterizzano ciascun diritto
