This paper sets out to look at the ways doctrinal and jurisprudential models effectively flow and communicate with each other within the “communicating world”. On the one hand, the seemingly apparent court prohibition set on express reference to a set of doctrines seems to lie behind the legal mindset of comparative lawyers and becomes only marginally relevant. On the other, however, the likely impact of legal doctrine on jurisprudence may be measured against varying standards which not only pertain to the legal sources and the ways these are ranked one above another and methodologically constructed and interpreted, but also significantly bear upon the style that is mutually taken by judgments and other such literary forms within and across...
