Persekongkolan dalan tender merupakan suatu bentuk kerjasama yang dilakukan oleh dua atau lebih pelaku usaha dan/ atau bersama pihak lain dalam rangka memenangkan peserta tender tertentu. Rumusan masalah dalam penelitian ini adalah Bagaimana bentuk dan unsur dalam persekongkolan tender pada pengadaan alat CT Scan di RSUD Dr. Pirngadi Medan Pada Tahun 2012. Bagaimana kewenangan Komisi Pengawas Persaingan Usaha dalam menangani perkara persekongkolan tender, serta kesesuaian putusan komisi terhadap undang-undang Undang-Undang Nomor 5 Tahun 1999 tentang Anti Monopoli dan Persaingan Usaha Tidak Sehat. Metode penulisan dalam tesis ini menggunakan metode penelitian yuridis normatif, yaitu dengan cara meneliti bahan pustaka yang berkaitan dengan permasalahan yang diteliti. Tesis ini bersifat deskriptif analisis dengan melakukan pendekatan terhadap perundang-undangan (Statue Approach) serta pendekatan kasus (Case Approach). Kesimpulan dari penelitian ini adalah terdapat tiga bentuk persekongkolan tender, yaitu persekongkolan vertikal, horizontal, dan gabungan. Suatu tindakan dapat dikategorikan sebagai persekongkolan tender harus memenuhi unsur-unsur pelaku usaha, bersekongkol, mengatur atau menentukan pemenang tender dan mengakibatkan terjadinya persaingan usaha yang tidak sehat. KPPU telah melaksanakan kewenangannya sesuai dengan ketentuan peraturan perundang-undangan yang berlaku mulai dari tahap penyelidikan hingga mengadili pelaku usaha yang terbukti melakukan persekongkolan horizontal dan vertikal sebagaimana diatur dalam pasal 22 Undang-Undang Nomor 5 Tahun 1999. Tindakan Administratif dalam Putusan komisi tidak sesuai dengan Pasal 47 ayat 2 huruf g Undang-Undang Nomor 5 Tahun 1999 tentang Anti Monopoli dan Persaingan Usaha Tidak Sehat. Conspiracy in tenders is a form of cooperation carried out by two or more business actors and / or with other parties in order to win certain tender participants. The formulation of the problem in this research is what are the forms and elements in the tender conspiracy in the procurement of CT Scan tools at Dr. Pirngadi Medan in 2012. What is the authority of the Business Competition Supervisory Commission in handling tender conspiracy cases, as well as the suitability of the commission's decision to Law Number 5 of 1999 concerning Anti-Monopoly and Unfair Business Competition. The method of writing in this thesis uses normative juridical research methods, namely by examining library materials related to the problems under study. This thesis is a descriptive analysis by using a statue approach and a case approach. The conclusion of this research is that there are three forms of tender conspiracy, namely vertical, horizontal and joint conspiracy. An action that can be categorized as tender conspiracy must meet the elements of business actors, conspire, regulate or determine the tender winner and result in unfair business competition. KPPU has exercised its authority in accordance with the provisions of the prevailing laws and regulations starting from the investigation stage to prosecuting business actors proven to have committed horizontal and vertical conspiracies as regulated in Article 22 of Law Number 5 Year 1999.
