Legal Analysis Regarding Criminal Acts of Children Involved in Motorcycle Gangs as Law Enforcement Efforts (Case Study at Medan Polrestabes)

Banyak pelaku geng motor mengaku bergabung dengan geng ini karena perlawanan dan kebencian kepada kondisi lingkungan sekitar. Isu klasik ini ada berlaku sehingga menjadi motivasi beberapa orang untuk bergabung dengan geng motor, dengan demikian geng motor dianggap sebagai bentuk pelarian (escapis) dari keterasingan yang mereka alami. Perumusan masalah dalam penelitian sebagai berikut: (1) Bagaimana aturan hukum yang mengatur batasan usia anak yang terlibat Geng Motor, (2) Bagaimana faktor penyebab terjadinya tindak pidana terhadap anak yang terlibat Geng Motor, (3) Bagaimana Kebijakan hukum yang dilakukan oleh pihak Kepolisian terhadap Anak yang terlibat Geng Motor. Jenis penelitian dalam penulisan ini menggunakan penelitian hukum normatif, yaitu penelitian yang mengacu kepada norma-norma hukum yang terdapat dalam peraturan perundang-undangan yang berlaku sebagai pijakan normatif. Penelitian hukum normatif adalah penelitian yang dilakukan dengan cara meneliti bahan pustaka (data sekunder) atau penelitian hukum perpustakaan. Aturan hukum yang mengatur batasan usia anak yang terlibat Geng Motor sebagai berikut: (a) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, (b) Undang-Undang Nomor 1 Tahun 1946 tentang KUHP, (c) Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan, (d) Undang-Undang Nomor 4 Tahun 1979 tentang Kesejahteraan Anak, (e) Undang-Undang Nomor 3 Tahun 1997 tentang Pengadilan Anak, (f) Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak, (g) Undang-Undang Nomor Nomor 35 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak, (h) Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak. 2. Faktor penyebab terjadinya tindak pidana terhadap anak yang terlibat Geng Motor adalah sebagai berikut: (a) Faktor Eksternal Penyebab Terjadinya Tindak Pidana Anak Yang Terlibat Geng Motor: (1) Keluarga Sebagai Penyebab Kenakalan Remaja dan Peranan Kontrol di Dalamnya, (2) Faktor Lingkungan Pergaulan. (3) Faktor Pendidikan (b) Faktor Internal Penyebab Terjadinya Tindak Pidana Anak Yang Terlibat Geng Motor: (1) Krisis identitas, (2) Kontrol diri yang lemah. 3. Kebijakan Hukum Yang Dilakukan Oleh Pihak Kepolisian Terhadap Anak Yang Terlibat Geng Motor: (a) Kebijakan Penal Terhadap Anak Yang Terlibat Geng Motor: (1) Tahap pertama apa yang disebut Pre-entif; (2) Tahap kedua yaitu Preventif; (3) Tahap ketiga yaitu Represif. (b) Kebijakan Non Penal Terhadap Anak Yang Terlibat Geng Motor (1) Melakukan Patroli; (2) Melakukan penertiban terhadap kelompok yang melakukan balap liar; (3) Melakukan Razia ke sekolah-sekolah terhadap sepeda motor yang tidak memiliki spesifikasi standar; (4) Melakukan penjagaan di simpang jalan yang rawan terjadi tempat berkumpulnya para geng motor.----------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------The existence of motorcycle gangs is actually resistance to existing conditions. Many motorcycle gang perpetrators admit to joining this gang because of resistance and hatred for the surrounding environment. This classic issue exists so that it becomes the motivation for some people to join motorcycle gangs, thus motorcycle gangs are considered as a form of escape (escapis) from the isolation they experience. The formulation of the problem in the research is as follows: (1) What are the legal rules that regulate the age limit of children involved in Motorcycle Gangs, (2) What are the factors that cause criminal acts against children involved in Motorcycle Gangs, (3) What are the legal policies carried out by the Police against children involved in motorcycle gangs. This type of research in this paper uses normative legal research, namely research that refers to the legal norms contained in the laws and regulations that apply as a normative footing. Normative legal research is research conducted by researching library materials (secondary data) or library legal research. The legal rules governing the age limit of children involved in Motorcycle Gangs are as follows: (a) the 1945 Constitution of the Republic of Indonesia, (b) Law Number 1 of 1946 concerning the Criminal Code, (c) Law Number 1 of 1974 concerning Marriage, (d) Law Number 4 of 1979 concerning Child Welfare, (e) Law Number 3 of 1997 concerning Child Courts, (f) Law Number 23 of 2002 concerning Child Protection, (g) Law Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection, (h) Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. 2. Factors that cause criminal acts against children involved in motorcycle gangs are as follows: (a) External Factors Causing Crime of Children Involved in Motorcycle Gangs: (1) Family as the Cause of Juvenile Delinquency and the Role of Control in it, (2) Factors Social Environment. (3) Educational Factors (b) Internal Factors Causing Criminal Acts of Children Involved in Motorcycle Gangs: (1) Identity crisis, (2) Weak self-control. 3. Legal Policies Implemented by the Police Against Children Involved in Motorcycle Gangs: (a) Penalty Policies Against Children Involved in Motorcycle Gangs: (1) The first stage is what is called Pre- entif; (2) The second stage is Preventive; (3) The third stage is Repressive. (b) Non-Penal Policy Against Children Involved in Motorcycle Gangs (1) Conducting Patrols; (2) Controlling groups that engage in illegal racing; (3) Conducting raids to schools on motorcycles that do not have standard specifications; (4) Conducting security at intersections that are prone to gathering places for motorcycle gangs
