Dalam penanganan perkara kekerasan dalam rumah tangga (KDRT) sebagaiman dimaksud dalam undang undang nomor 23 tahun 2004 dalam bentuk kekerasan fisik, psikis, seksual dan penelantaran dimana pelaku dan korban adalah orang yang tinggal dalam satu rumah dan masih ada ikatan hubungan suami istri, anak, hubungan darah, perkawinan dan persuasuan maupn asisten rumah tanggal yang tinggal menetap dalam satu rumah Salah satu cara yang dapat dilakukan dalam penelesaian perkara Kekerasan dalam lingkup rumah tangga yang berupakan pidana aduan dan tergolong ringan adalah melalui keadilan restoratif dengan mendepankan mediasi penal. Penyelesaian kasus Kekerasan Rumah Tangga (KDRT) Melalui restorative justice dapat dirumuskan permasalahan yang kan diteliti yaitu bagaimana aturan hukum penyelesaian kasus KDRT melalui Restoraive Justice, apa yang menjadi kendala penyelesaian kasus KDRT melalui Restorative Justice dan apa upaya yang dilakukan Polda Sumut dan masyarakat dalam penyelesaian kasus KDRT melalui restorative justice.. pada pelaksanaan penyelesaian kasus kdrt melalui restorative justice aturan hukum yang dipedomani Polda Sumut adalah Undang Undang Nomor 2 Tahun 2002 Tentang Kepolisian Republik Indonesia, Pasal 16 dan 18, Surat Edaran Kapolri nomor 08 /VII/2018, Perkap nomor 6 tahun 2019 tentang penyidikan tindak pidana pasal 12 dimana aturan hukum itu mengacu pada pasal 7 (1) huruf j undang undang nomor 8 tahun 1981 tentang hukum acara pidana, kendala yang ditemukan adalah faktor aturan hukum, penegakan hukum, sarana prasarana, kesadaran hukum masyarakat dan budaya, pada pelaksanaan penyelesaian kasus KDRT Polda Sumut telah melakukan upaya melakukan mediasi terhadap pelaku dan korban dengan data penyelesaian kasus KDRT dari laporan Polisi yang diterima dalam perkara KDRT tahun 2017 jumlah kasus 889 selesai secara mediasi 820 kasus, tahun 2018 jumlah kasus 751 selesai melalui mediasi 645 kasus tahun 2019 jumlah kasus 385 selesai melalui mediasi 300 kasus, dari rumusan masalah dan kesimpulan diatas maka penyelesaian kasus KDRT melalui Restorative Justice aturan hukumnya harus dirumuskan dalam bentuk Undang Undang, diperlukan peningkatan sumber daya manusia yang profesional sebagi mediator melalui pendidikan khusus di dukung sarana prasarana dan pemahaman hukum kepada masyarakat dan dalam penyelesaian kasus KDRT sangat tepat dilakukan melalui restorative justice dengan biaya murah dan ditemukan kepastian hukum dan kemanfaatan hukum. In handling cases of domestic violence (KDRT) as referred to in law number 23 of 2004 in the form of physical, psychological, sexual violence and neglect where the perpetrator and the victim are people who live in one house and there is still a relationship between husband and wife, children, blood relations, marriage and friendship as well as household assistants who live permanently in one of the ways that can be done in resolving cases of domestic violence which is a criminal complaint and is classified as minor is through restorative justice by promoting penal mediation. Settlement of cases of Domestic Violence (KDRT) Through restorative justice, the researched problems can be formulated, namely how the legal rules for resolving domestic violence cases through Restorative Justice, what are the obstacles to solving domestic violence cases through Restorative Justice and what are the efforts made by the North Sumatra Regional Police and the community in solving cases Domestic violence through restorative justice .. in the implementation of Kdrt case settlement through restorative justice, the legal rules guided by the North Sumatra Regional Police are Law Number 2 of 2002 concerning the Indonesian Police, Articles 16 and 18, Circular of the Chief of Police Number 08 / VII / 2018, Perkap number 6 year 2019 concerning investigation of criminal offenses article 12 where the rule of law refers to article 7 (1) letter j of law number 8 of 1981 concerning criminal procedural law, the obstacles found are factors of legal rules, law enforcement, infrastructure, public legal awareness and culture, on the implementation of cash settlement us KDRT Polda North Sumatra has made efforts to mediate against perpetrators and victims with data on the settlement of domestic violence cases from Police reports received in domestic violence cases in 2017, the number of cases was 889 completed by mediation 820 cases, in 2018 the number of cases 751 were completed through mediation 645 cases in 2019 the number 385 cases were completed through mediation of 300 cases, from the formulation of the problems and conclusions above, the resolution of domestic violence cases through Restorative Justice, the legal rules must be formulated in the form of a law, it is necessary to increase professional human resources as mediators through special education supported by infrastructure and legal understanding to the community and in the settlement of domestic violence cases it is very appropriate to do it through restorative justice at low cost and legal certainty and legal benefits are found
