TINJUAN HUKUM ISLAM TERHADAP JUAL BELI TANAMAN HIAS DI KECAMATAN BABAT KABUPATEN LAMONGAN

This research is entitled Review of Islamic Law Against the Sale and Purchase of Ornamental Plants in Babat District, Lamongan Regency. This study aims to describe the analysis of Islamic law on the sale and purchase of ornamental plants in Babat Subdistrict, Lamongan Regency. The sale and purchase is classified as the practice of buying and selling garar, because the practice of buying and selling only benefits one party, namely the seller who deliberately takes the maximum profit because the plant is booming. The phenomenon of the soaring price of ornamental plants is influenced by the inflated price by unscrupulous sellers and several parties who have collaborated by using certain strategies that do not make sense (irrational). This study uses a qualitative descriptive method, the data source that researchers use in this study is news on the internet about the phenomenon of buying and selling ornamental plants which is booming, data analysis using deductive analysis. The result of the research is that the sale and purchase of ornamental plants is booming and contains elements of price engineering so that the law is not valid (fâsid). Even though it fulfills the pillars and conditions of buying and selling in Islam, because there is an element of fraud by engineering prices. This sale and purchase includes buying and selling which is prohibited in Islamic law because it is included in the sale and purchase that is engineered (najasy). From the maqashid aspect of sharia, the sale and purchase of the Monstera Adansonii plant is included in the need for t h sīniyyat, because this sale and purchase is not to meet primary or secondary needs and is included in the isrâf category (excessive attitude in spending wealth)
