The presence of Law no. 16 of 2011 concerning Legal Aid is proof of the guarantee of constitutional rights for every community to obtain fair recognition, guarantees, protection, and legal certainty as well as equal treatment before the law. The basic problem that often occurs is the lack of understanding and ignorance of the community, especially the poor (poor) who are dealing with the law regarding the existence of legal aid. Therefore, the role of a Legal Aid Institute in providing legal assistance, especially in the criminal case process, is very important. Where the defendant of a crime is also entitled to legal assistance in the form of assistance until the legal problems he faces are completed. In this study, the author uses a sociological juridical legal research method. The results of this study indicate that in practice, the role of a Legal Aid Institute in providing legal assistance to underprivileged defendants has been running in accordance with what is stated in the applicable laws and regulations and also in this case the rights of the accused of the crime. has been maintained.
