The Arctic, Russia and Coercion of Navigation in the 21st Century

Dissertação para obtenção de grau de Mestre em EstratégiaThe present study considers the geographic changes in the Arctic caused by climate change in the 21st Century that enables higher access to maritime navigation in the Northern Sea Route (NSR) and Northwest Passage (NWP) and higher access to the exploitation of potential energy resources. It is in this context of higher accessibility to the sea, that we have focused our thesis on freedom of navigation in the NSR from strategic and geopolitical perspectives. Thus, our general goal focuses on considering and understanding the role of the United Nations Convention on the Law of the Sea (UNCLOS) as a coercion mechanism to be disposed and employed by the Ministry of Transport of the Russian Federation, considering the Russian naval power projection capacity (analyzing the Northern Fleet and the Russian Coast Guard). From the geopolitical perspective, the Arctic slowly loses its defense characteristics. In light of global warming, the Arctic poses challenges, but at the same time opportunities for Russia. With a more accessible Arctic, Russia seeks not only to develop its seapower, but also ensure sovereignty and territorial integrity. We conclude that, clearly, the Arctic constitutes a strategic region that Russia considers to be crucial for the economic development, wishing to develop and protect it from outsiders. This thesis is a single case study that has adopted deductive reasoning based on the theoretical framework of the General Theory of Strategy written by António Silva Ribeiro, from where we have deduced hypotheses about the Law of the Sea’s efficiency in ensuring freedom of navigation in the NSR. This thesis has concluded that the limitations in the Law of the Sea are being used by the Russian Ministry of Transport to create a different legal regime for the NSR, which restricts freedom of navigation. The Law of the Sea can be seen as a coercion mechanism when international law rules are combined with the naval power (or naval strength) of a coastal state.A presente dissertação considera as mudanças geográficas no Ártico provocadas pelo aquecimento global no século XXI que permite um maior acesso às rotas de navegação como a Northern Sea Route (NSR) ou a Northwest Passage (NWP) bem como a exploração de potenciais recursos energéticos. É neste contexto de maior acessibilidade ao mar que o foco da nossa dissertação consiste em analisar a liberdade de navegação na NSR da perspetiva dos estudos estratégicos e geopolíticos. Assim, o nosso objetivo geral foca-se em considerar e compreender o papel da Convenção das Nações Unidas sobre o Direito do Mar (CNUDM) enquanto mecanismo de coação a ser disposto e empregue pelo Ministério do Transporte da Federação Russa, tendo em conta a capacidade de projeção de poder naval russo (a Frota do Norte e a Guarda Costeira Russa). Da perspetiva geopolítica, o degelo torna o Ártico muito mais acessível o que, por um lado, faz com que a Rússia esteja mais vulnerável, mas, por outro lado, tenha uma oportunidade em desenvolver-se maritimamente. Assim, à medida que o Ártico deixa de ser uma barreira defensiva, a Rússia tem como objetivo garantir a sua soberania e integridade territorial, como é estabelecido pela Política Russa para o Ártico, “Foundations of the Russian Federation’s State Policy in the Arctic for the Period to 2035”. Podemos concluir que o Ártico constitui um espaço estratégico para a Rússia pois esta considera que é uma região fundamental para a continuação do desenvolvimento económico do país. Por um lado, a Rússia tem como objetivo desenvolver esta região, mas, ao mesmo tempo, também proteger. Esta dissertação coincide com um estudo de caso que adotou a lógica dedutiva assente num quadro geral teórico baseado na Teoria Geral da Estratégia de António Silva Ribeiro para deduzir hipóteses sobre a eficácia do Direito do Mar em garantir a liberdade de navegação na NSR. Conclui-se que o Ministério do Transporte Russo beneficia das limitações do Direito do Mar para criar um quadro de regulamentação diferente para a NSR, onde a liberdade de navegação é posta em causa com o objetivo de aumentar o controlo sobre a rota. O Direito do Mar pode ser visto enquanto mecanismo de coação como resultado da combinação de regras da CNUDM e do poder naval de um estado costeiro.N/
