ANALISIS YURIDIS SANKSI PIDANA PENJARA PADA ANAK SEBAGAI PELAKU PENYALAHGUNAAN NARKOTIKA (STUDI KASUS PUTUSAN NOMOR 4/Pid.Sus-Anak/2019/PN.Pbl)

The imposition of criminal sanctions in prison on children is not the best solution for giving punishment to children who are perpetrators of narcotics abuse, this is done none other than to avoid causing deep trauma for children in the future and also to protect the rights and interests of the child. This writing discusses what the judge's considerations are in giving prison sentences to children as perpetrators of narcotics abuse and how the construction of criminal sanctions given by judges to children. This study uses a sociological juridical method with data collection by interview, documentation, and literature study then the data that has been obtained was analyzed using a qualitative descriptive method. The results of this author's research indicate that the basis for consideration is not appropriate because it does not pay attention to the provisions contained in the Juvenile Criminal Justice System Act and the Child Protection Act. The imposition of criminal sanctions in prison given to children can be stigmatizing and dehumanizing. The author's suggestion is to pay more attention to the provisions contained in the law, and as a society to pay more attention to and assist in the prevention of narcotics abus
