ANALISIS IMPLEMENTASI BASEL CONVENTION TERHADAP PRAKTIK IMPOR SAMPAH YANG TERKONTAMINASI LIMBAH B3 (STUDI DI BEA CUKAI TANJUNG PERAK)

It was found that the presence of a mixture of hazardous waste in imports carried out in order to fulfill paper raw materials at the Tanjung Perak Customs is something that needs to be considered more deeply regarding the field implementation of the Basel Convention. Indonesia strictly prohibits the import of B3 or the presence of a mixture in imported goods, but there are B3 contaminants after further inspection on the import of Non-B3 Waste. In this study the authors found several alignments in the policies established by the government and became a reference for Tanjung Perak Customs, namely imposing re-export procedures in accordance with Article 9 of the Basel Convention against goods that are included in the illegal category. In addition to regulatory alignment, the author's findings are that re-export procedures have been carried out for cases that occurred at Tanjung Perak Customs in 2019 related to the presence of B3 contaminants in imported Non-B3 Waste containers, but the implementation found was only procedural and not in writing through Standard Operating Procedures at Tanjung Perak Customs.
