KAJIAN SOCIO LEGAL KENDALA PENERAPAN RESTORATIF JUSTICE PADA TINDAK PIDANA RINGAN DI WILAYAH HUKUM KABUPATEN PAMEKASAN

Minor crimes in the jurisdiction of Pamekasan Regency are increasing in intensity as reports received by the Pamekasan Police as the main entry point for reports when a crime occurs. All efforts have been made by the authorities, in this case, the Police, in suppressing the number of crimes that occur within the jurisdiction of Pamekasan Regency, but they have not completely stopped the occurrence of crimes. Along with this, several problems emerged related to the resolution of the problem, First, there was no refund of losses for victims who had suffered losses due to criminal acts that occurred, Second, overcapacity in the Correctional Institution which caused a swelling of the expenditure of APBN funds to finance the lives and needs of prisoners. Since then, Restorative Justice is considered to be the right method of settlement in responding to this problem, whereby implementing Restorative Justice, will restore the situation for the litigants by returning the losses suffered by the victim and will restore the perpetrator's condition so that it can be accepted by the community and reduce overcapacity in Correctional Institutions. This study aims to determine and examine the positive impact of the realization and the negative impact of the non-realization of Restorative Justice on the settlement of minor crimes that occurred, to find out this study was carried out with a Socio-Legal Study with a direct approach by looking at what happened in the field and then in the field. synchronize with the applicable laws. The process of collecting data with secondary and primary data will then be analyzed how the results of the positive and negative impacts of not implementing Restorative Justice in Minor Crimes themselves then how law enforcers improve their performance in order to achieve the goals of Restorative Justice itself so that it can be carried out properly
