KAJIAN YURIDIS SOSIOLOGIS TENTANG MODIFIKASI KENDARAAN BERMOTOR TERHADAP SANKSI DALAM KAITANNYA DENGAN KESELAMATAN BERLALU LINTAS DITINJAU DARI PASAL 285 AYAT (1) UNDANG-UNDANG NOMOR 22 TAHUN 2009 TENTANG LALU LINTAS DAN ANGKUTAN JALAN (STUDI DI SATUAN LALU LINTAS POLRES KABUPATEN LUMAJANG)

The background of this research is the high level of motor vehicle modification traffic violations in Lumajang Regency. Based on the background, it is known that the first research problem is, how is the effectiveness of Article 285 Paragraph (1) of Law Number 22 Year 2009 concerning Road Traffic and Transportation on motor vehicle modification in Lumajang Regency. The two obstacles in the implementation of the effectiveness of the Act. Thus, the purpose of this study is to determine the implementation of Article 285 Paragraph 1 of Law No. 22 of 2009 concerning Road Traffic and Transportation, especially those relating to motor vehicle modifications to traffic safety. The method in this research is using a sociological juridical approach. The object of this research is the violation of motor vehicle modification in Lumajang Regency. The data collection technique used is through direct observation and interviews. The results of the research conducted indicate that the implementation of Law Number 22 Year 2009 Article 285 Paragraph 1 in Lumajang Regency is still less effective. This is indicated by the many violations of motor vehicle modification in Lumajang Regency and the obstacle to the implementation of the Act is the low legal awareness of the people of Lumajang Regency in complying with regulations. In addition, the lack of firmness of the apparatus in taking action against violations and the schedule of raids of the Lumajang Regency Resort Police Traffic Unit has not been right on target. Suggestions in this study are to increase public legal awareness by socializing the law and taking strict action against modification violations and improving the raid schedule
