JAMINAN PEMENUHAN HAK-HAK KORBAN KEKERASAN SEKSUAL SEBAGAI WUJUD PERLINDUNGAN HUKUM BAGI KORBAN KEKERASAN SEKSUAL DI MEDIA SOSIAL

Sexual violence is all acts that meet the elements of a crime. In Indonesia there are many positive laws, but only focus on punishment or sanctions for perpetrators, the law in Indonesia only talks about the protection of victims. Therefore, it is an interesting discussion to study. So the author uses the title of his thesis research is Guarantee the Fulfillment of the Rights of Victims of Sexual Violence as a Form of Legal Protection for Victims of Sexual Violence on Social Media. In this study, the author formulates the problem of how to fulfill the rights of victims of sexual violence on social media according to positive legal arrangements and what are the procedures for obtaining protection for victims of sexual violence through social media according to the law. This research was conducted with the aim of knowing how witnesses and victims obtain legal protection and how the process is to obtain legal protection. To answer these problems the author uses the method used is the normative juridical research method that uses data in the form of library materials, judges' decisions, jurisprudence, laws and those concerning legal issues. The results of this study show that there are many positive laws that discuss sexual violence such as the Criminal Procedure Code, Law No. 31 of 2014 concerning PSK, Law No. 12 of 2022 concerning TPKS, Government Regulation No. 7 of 2018 concerning the provision of compensation, restitution and victim witness assistance, Law No. 23 2004 concerning Domestic Violence, Law No. 19 of 2016 concerning ITE, Law No. 44 of 2008 concerning Pornography. Each law has a different discussion regarding sexual violence, such as regulation of actions, sanctions for perpetrators, victims' rights and procedures that must be carried out. The author's recommendation is that there is a lack of positive law in Indonesia that discusses the protection of witnesses and victims, so the need for a complete and comprehensive regulation related to positive law relating to sexual violence
