The symbolic effectiveness reproduction on the rural land reforms in Colombia. The implementation of the final peace agreement on the decree-law 902 of 2017

ilustraciones, mapasThe Decree-law 902 of 2017, does not represent a definitive solution for the lack of equitable distribution of land, in regards of what is established in the section 1.1 of the final agreement to end the armed conflict and build a stable and lasting peace. All the current legislative initiatives for the rural area do not address neither the concentration of land ownership nor the proposed objectives of the beforementioned agreement, i.e. creation of rural, economic and social development zones, entitlement formalization of lands over the size of a family farm and the access to rural property to people that do not belong to vulnerable peasant populations. The Decree-Law 902 of 2017 has been proposed in order to implement the section 1 of the final peace agreement, along with the massive entitlement of land, which limits the action of the farmer on the land usage. This reproduces the main components of former failed land reforms that have historically increase the concentration of land ownership and worsen the rural inequality. Hence, we identify the extensive use of “symbolic effectiveness” on the implementation of the integral rural land reform. For this reason, we analyze this problem from the theoretical approach of the decolonial studies and through the following research question: Why the land reform established by the Decree-law 902 of 2017, is provided of symbolic effectiveness in regards of a fair land distribution to farmers? opposing what was proposed in the section 1.1 of the final agreement to end the armed conflict and build a stable and lasting peace.El Decreto Ley 902 de 2017 no presenta una solución definitiva para la falta de uso y redistribución equitativa de la tierra en virtud de lo establecido en el numeral 1.1 del Acuerdo Final de Paz. Los mecanismos jurídicos actuales para el sector rural prolongan la concentración de la tierra y son contrarios al objetivo propuesto en el Acuerdo Final (A. F.) Ellos son las zonas de interés de desarrollo rural, económico y social, la formalización de tierras superiores a una unidad agrícola familiar y el acceso a la propiedad rural de sujetos que no cumplen con la condición de población campesina vulnerable. En efecto, el DL 902 de 2017 se ha establecido como medida para implementar el punto primero del A. F., junto con la titulación masiva de la tierra, lo que limita la acción del campesino sobre su uso. Esto reproduce elementos de las anteriores reformas agrarias fallidas, que históricamente no han permitido la distribución de la tierra y han propiciado la desigualdad en el sector rural. De hecho, se identifica que se dota de “eficacia simbólica” la implementación de la Reforma Rural Integral (RRI). Por esta razón, se hace un análisis de esta problemática con un enfoque decolonial mediante la siguiente pregunta: ¿Por qué la Reforma Rural Integral, implementada en el DL 902 de 2017 como uno de sus mecanismos, está dotada de eficacia simbólica, en cuanto a una real distribución de la tierra al campesinado, en contravía en lo estipulado en el numeral 1.1. del Acuerdo Final?
