Can Ronald Dworkin be an Originalist?

This study is devoted to an issue that is catching the attention of the current American constitutional debate and concerns the originalism of Ronald Dworkin. A fundamental feature of this debate is the ongoing dispute over what the correct interpretation of the US Constitution is. “Originalism”, which has hitherto been at the forefront of constitutional interpretative methods due to its numerous elaborations, has acquired such many meanings, concerning both the meaning of originalism and original meaning, that it is considered to have deprived itself of the possibility of being a unified theory. Seeking positive solutions to the problem, some American constitutionalists and legal theorists put forward the bold thesis that Dworkin, despite popular opinion, may be an originalist. His originalism, however, has a different meaning than has been presented so far. They call Dworkin’s originalism “new”, more normative, seeing in it a coherent theory of interpretation. The main purpose of this paper is to introduce the notion of American originalism as well as to briefly present the positions that prove that Dworkin can be an originalist.Niniejsze opracowanie poświęcone jest zagadnieniu, które przykuwa uwagę aktualnej amerykańskiej debaty konstytucyjnej i dotyczy oryginalizmu Ronalda Dworkina. Fundamentalną cechą tej debaty jest ciągły spór o to czym jest prawidłowa interpretacja Konstytucji USA. „Oryginalizm”, który dotąd przodował w konstytucyjnych metodach interpretacji z uwagi na liczne opracowania uzyskał tak dużą ilość znaczeń, dotyczących zarówno znaczenia pojęcia originalism jak i original meaning, iż uważa się, że pozbawił się możliwości bycia jednolitą teorią. Dociekając pozytywnych rozwiązań problemu niektórzy amerykańscy konstytucjonaliści i teoretycy prawa stawiają śmiałą tezę, że Dworkin pomimo obiegowej opinii może być oryginalistą. Oyginalizm jego ma jednak odmienne niż dotychczas prezentowane znaczenie. Oryginalizm Dworkina nazywają „nowym”, bardziej normatywnym, dostrzegając w nim spójną teorię interpretacji. Zasadniczym celem niniejszej pracy jest przybliżenie pojęcia amerykańskiego oryginalizmu jak i zwięzłe zaprezentowanie stanowisk współczesnych amerykańskich badaczy świadczących o tym, że Dworkin może być oryginalistą
