Should the Polish Constitution be Changed During a Pandemic - Contribution to the Discussion

In this speech I will present the role and importance of the Constitution of the Republic of Poland in maintaining certainty and stability of the law and system. Considerations in this regard will serve to verify the thesis that the duration of a pandemic is not appropriate for making changes. Then, the arguments justifying the thesis will be presented, based, on the one hand, on the history and reality of the extraordinary situation that occurs - the pandemic, and on the other hand, based on the legislative experience from the period of the ongoing pandemic. Their examination will allow to highlight the doubts related to the amendment of the Basic Law in a specific, extraordinary time - the period of the pandemic, and the shortcomings of the legislative mode, which was used by the legislature during the pandemic.W niniejszej wypowiedzi przybliżona zostanie rola i znaczenie Konstytucji RP w zachowaniu pewności oraz stabilności prawa i ustroju. Poczynione rozważania w tym zakresie posłużą do zweryfikowania tezy mówiącej, iż okres trwania pandemii nie jest właściwy dla dokonywania zmian. Następnie przedstawione zostaną argumenty uzasadniające postawioną tezę, oparte z jednej strony, na historii i realiach nadzwyczajnej sytuacji jaka występuje - pandemii, a z drugiej zaś strony bazujące na doświadczeniach legislacyjnych z okresu trwającej pandemii. Ich badanie pozwoli uwydatnić wątpliwości związane ze zmianą ustawy zasadniczej w specyficznym, nadzwyczajnym czasie - okresie pandemii, a także mankamenty trybu ustawodawczego, którym posługiwał się ustawodawca w czasie pandemii
