EL PROCESO MONITORIO EN LA LEY 902, CÓDIGO PROCESAL CIVIL DE LA REPÚBLICA DE NICARAGUA

Through this article it is in our interest to develop the regulation of the MONITORING PROCESS in the national legislation, Law 902, Civil Procedure Code of the Republic of Nicaragua, but not before addressing the conceptual aspects of it, so we will resort to a section I (one) to develop what in this regard considers the doctrine from its etymology, concepts, to historical background in comparative laws such as the case of Italy, to later focus on the process according to our legislation, with aspects such as their nature, characteristics, principles that They govern and the procedure itself. We believe that in this way we will be contributing humbly to the strengthening of the knowledge of our students of the Law degree and to all those professionals who are interested in this subject.Mediante el presente artículo es de nuestro interés desarrollar la regulación del PROCESO MONITORIO en la legislación nacional, Ley 902, Código Procesal Civil de la República de Nicaragua, no sin antes abordar los aspectos conceptuales del mismo por lo cual recurriremos en un acápite I a desarrollar lo que al respecto considera la doctrina desde su etimología, conceptos, hasta antecedentes históricos en legislaciones comparadas como por ejemplo el caso de Italia, para posteriormente centrarnos en el proceso conforme a nuestra legislación, con aspectos tales desde su naturaleza, características, principios que le rigen  y el procedimiento mismo. El procedimiento monitorio facilita la celeridad y brinda un tratamiento especial para la exigencia de deudas monetarias conforme a la cuantía establecida. Consideramos que de esta manera estaremos contribuyendo humildemente al fortalecimiento del conocimiento de nuestros estudiantes de la carrera de Derecho y a todo aquel profesional que se muestre interesado en el tema
