نقش تراریخته‌ها در برون‌رفت از بحران آب؛ جرم‌انگاری بایسته در حمایت از امنیت غذایی

Background and Aim: Water is the cause of appearance, persistence and efficiency. Insecurity arising from the lack of sustainable access to water resources for citizens may disturb stability and security and challenge the legitimacy of the political system. Preventing water insecurity in hydropolitical relationships requires legal protection of water against water crimes and infractions. Methods: This article is theoretical and uses data from books, articles and relevant laws and regulations to critically analyze legal protection of water and biosafety laws in a qualitative and non-statistical research method. Ethical Considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Results: Criminal protection, through coercive prevention and determining punishments for water crimes, is one of the deterrents to the escalation of the agricultural crisis in Iran; A crisis that increases the need to import agricultural and food products with the decline of water resources and poor water management. As a result, the growth of imports of unsafe transgenics, leading to a preference for food security over the right to "healthy" food, is causing other crises. Today, new food and ecosystem technologies have such a moral value that adequate and accurate criminal protection is necessary. The weakness of domestic laws and legal procedures both in protecting water and in protecting the rights of consumers of GMOs, requires criminalization aimed at protecting food security in the increasing need for transgenics in the water crisis.    Conclusion: This article critiques some of the existing rules and regulations on criminal protection of water and biosafety in the consumption of transgenic food, providing a framework for criminalizing criminal behavior against the food supply chain with absolute responsibility - or with the presumption of criminal responsibility. Criticizing the articles of criminal and non-criminal laws related to GMOs and crimes against water, along with presenting draft articles to be added to the Bill on Punitive Punishments, in order to hold the government and private legal entities responsible for the implementation and monitoring of food safety laws, in compliance with the "principle The minimal and limited intervention of punishment as a last resort" is the target of this article; Therefore, limiting severe punishments to bioterrorist and organized types of crimes against food security provides a variety of legal responses that are appropriate to the nature and severity of the wide range of these crimes. Akhlaq-i zisti, i.e., Bioethics Journal. 2022; 12(37): e17.زمینه و هدف: آب، عامل پیدایی، مانایی و کارایی است. نا‌امنی برخاسته از عدم دسترسی پایدار به منابع آب برای شهروندان می‌تواند ثبات و امنیت را برآشوبد و به چالش مشروعیت نظام سیاسی بیانجامد. پیشگیری از ناامنی آب در مناسبات هیدروپلتیک، حمایت حقوقی از آب در برابر جرائم و تخلفات آبی را ضرورت می‌بخشد. روش: این مقاله از نوع نظری است و با بهره­گیری از داده‌های کتب، مقالات و قوانین و مقررات مربوطه به تحلیل انتقادی پیرامون حمایت حقوقی از قوانین ایمنی آب و ایمنی زیستی به روش تحقیق کیفی و غیرآماری می‌پردازد. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: حمایت کیفری، از طریق پیشگیری قهرآمیز و کیفرگذاری برای جرائم علیه آب، یکی از عوامل بازدارنده از تشدید وخامت بحران کشاورزی در ایران است؛ بحرانی که با افت منابع آبی و مدیریت نابهینه آب، نیاز به واردات محصولات کشاورزی و فراورده‌های غذایی را افزایش می‌دهد، در نتیجه رشد واردات تراریخته‌های ناامن با ترجیح ناموجه حفظ امنیت غذایی بر حق غذای «سالم»، بحران‌های دیگری می‌زاید. امروزه فناوری‌های نوین مواد غذایی و زیست‌بوم از چنان ارزش اخلاقی برخوردار است که حمایت کیفری کافی و دقیق از آن ضروری می‌نماید. ضعف قوانین و رویه‌های حقوقی ایران هم در حمایت از آب و هم در حمایت از حقوق مصرف‌کنندگان محصولات تراریخته، جرم‌انگاری معطوف به حمایت از امنیت غذایی در وضعیت فزایندگی نیاز به تراریخته‌ها در بحران آب را لازم می‌نماید. نتیجه‌گیری: این مقاله، با طرح چند نقد بر قوانین و مقررات موجود در حوزه حمایت کیفری از دو موضوع آب و ایمنی زیستی در مصرف تراریخته‌های خوراکی، چارچوبی برای جرم‌انگاری رفتارهای مجرمانه علیه زنجیره تأمین غذا با مسئولیت مطلق ـ یا حاوی فرض مسئولیت کیفری ـ ارائه می‌کند. نقد مواد قوانین کیفری و غیر کیفری مربوط به محصولات تراریخته و جرائم علیه آب، همراه با ارائه پیش‌نویس موادی برای الحاق به لایحه مجازات‌های تعزیری، جهت مسئول‌شناختن دولت و اشخاص حقوقی عمومی و خصوصی مسئول در اجرا و پایش قوانین امنیت غذایی، با رعایت «اصل مداخله کمینه و محدود کیفر به آخرین حربه» مورد هدف این نوشتار است؛ لذا تحدید کیفرهای سخت به انواع بیوتروریستی و سازمان‌یافته جرائم علیه امنیت غذایی، تنوع پاسخگذاری حقوقی متناسب با ماهیت و شدت گستره وسیع این جرائم را فراهم می‌کند
