Arbitraje: Mecanismo alternativo de solución de conflictos o privatización judicial

This paper aims at analyzing arbitration, which has come to be identified as an alternative mechanism for conflict resolution, but that  by studying how it has been configured over time, and its current  operation, responds to a model of private justice, which is adapted from the very beginning to respond to the interests of one sector of the population in particular, such as traders. Through deductive method it was established as general assumptions regarding free access to justice and the right to equality are decimated to an erroneous acceptance of arbitration as an alternative to justice option and not as a mere privatization of the same.En el presente trabajo se pretende realizar un análisis del arbitraje, el cual ha venido siendo identificado como un mecanismo alternativo de solución de conflictos, pero que al estudiar la forma como se ha configurado a través del tiempo y su funcionamiento actual, responde más a un modelo de justicia privada que se encuentra adaptado desde sus mismos orígenes para responder a los intereses de un sector de la población en especial, como son los comerciantes. A través del método deductivo se logró establecer como presupuestos generales relativos al libre acceso a la justicia y el derecho a la igualdad se ven diezmados ante una aceptación errónea del arbitraje como opción alternativa a la justicia, y no como una mera privatización de la misma.&nbsp
