A Responsabilidade Civil das Inteligências Artificiais e a Estratégia Brasileira

This article aims to analyze the emergence and development of systems equipped with artificial intelligence, as well as their growing use in our daily lives. With the increase in the complexity of these autonomous algorithms, questions of a legal nature are raised regarding the liability for any damages verified as a result of the use of these systems, seeking to define a chain of responsibility that is compatible with civil and consumer legislation. This research, dealing with a relatively modern and poorly consolidated theme, was developed under qualitative and exploratory methods, seeking references in other articles, as well as in foreign and national regulations. With the support of the national and German literature, and also analyzing the initiatives of the European Union and the Brazilian Strategy itself, it was concluded that the current legal system is able to regulate this new technological scenario, provided that the necessary measures are taken to manage the risks and repair the damage resulting from these new legal relationships.O presente artigo se propõe a analisar o surgimento e desenvolvimento de sistemas dotados de inteligência artificial, bem como o seu emprego crescente em nosso dia a dia. Com o aumento da complexidade desses algoritmos autônomos, levantam-se questões de ordem jurídica quanto à responsabilização por eventuais danos verificados em decorrência da utilização desses sistemas, procurando definir uma cadeia de responsabilidade que seja compatível com a legislação cível e consumerista. Esta pesquisa, ao tratar de um tema relativamente moderno e pouco consolidado, foi desenvolvida sob os métodos qualitativo e exploratório, buscando referências em outros artigos, bem como em regulamentos estrangeiros e nacionais. Com o apoio da doutrina pátria e alemã, e analisando também as iniciativas da União Europeia e a própria Estratégia Brasileira, concluiu-se que o ordenamento jurídico vigente é apto para regular esse novo cenário tecnológico, desde que adotadas as medidas necessárias para gerir os riscos e reparar os danos decorrentes dessas novas relações jurídicas
