Repercusiones del Desminado Humanitario en el Acuerdo de Paz en Colombia: una Mirada desde el Departamento de Antioquia

In the current context and progress in the implementation of the Peace Agreement between theGovernment of Colombia and the FARC-EP. Rural society has been affected, this can be evidenced inthe non-compliance with the final provisions of international and national conventions that precededthe establishment of the peace talks with the FARC-EP in Havana, Cuba, and, subsequently to the ratification and adjustments to the agreement at the Teatro Colón in Bogotá. It is precisely the signingof the: “Final Agreement for the termination of the conflict and the construction of a stable andlasting peace”, which projected the demilitarization and the abandonment of improper and unjustifiedpractices, were the elements that motivated this research project. The same that has focused on theidentification of its object of study in the period between 2016 - 2019, with the need to consider whathas been done so far around humanitarian demining agreed between the (FARC-EP and the Government of Colombia). It is for this reason that we have tried to make a brief approach to the reasons andthe use that were given to these artifacts, in addition to taking into account the recent history of the Colombian conflict, from the highest moment in the escalation of the conflict and its de-escalationsince 2016 and what has been implemented until 2019. And a second moment where a case study iscarried out on the situation in the department of Antioquia and the experience of humanitarian demining after the implementation of the peace agreement.Therefore, the use of these devices in the recent history of their use by the Armed Groups outsidethe Law has been taken into consideration, precisely to the former FARC-EP, its zones of militaryaction, and the impossibility of handing over previously delimited areas to misuse these devices andin breach of international conventions (Ottawa) and the final agreement for the termination of theconflict. Finally, we want to inquire about the role of the Special Justice for Peace (JEP), its jurisdiction,and violations of Human Rights and IHL.En el contexto actual y el avance en la implementación del acuerdo de Paz entre el Gobierno de Colombia y las FARC-EP se ha visto afectada la sociedad civil en especial del área rural, esto se puede evidenciar en el incumplimiento a las disposiciones finales de convenciones internacionales y nacionales que precedieron al establecimiento de las conversaciones de paz con las FARC-EP en la Habana, Cuba y, de manera posterior a la ratificación y ajustes al acuerdo del Teatro Colón de Bogotá. Es precisamente, la suscripción del: “Acuerdo Final para la terminación del conflicto y la construcción de una paz estable y duradera”, que proyectó la desmilitarización y el abandono de prácticas indebidas y no justificadas, lo que motivó el proyecto de investigación que originó esta publicación. En este sentido, la identificación del objeto de estudio se delimita en dos momentos: el primero, en el periodo comprendido entre el 2016-2019, con la necesidad de tomar en consideración lo que hasta el momento se ha realizado en el aspecto del desminado humanitario acordado entre las (FARC-EP y el Gobierno de Colombia). En este sentido, el propósito es realizar una aproximación breve a las razones y el uso que se le dio a las Minas Antipersonal (MAP), artefactos explosivos improvisados (AEI) y municiones sin explotar (MUSE), además, de tener en consideración la historia reciente del conflicto colombiano, desde el momento más alto en el escalamiento del conflicto y su des escalamiento desde el 2016 y lo que se ha implementado hasta el año 2019. Y un segundo momento donde se realiza un estudio de caso de la situación del departamento de Antioquia y la experiencia del desminado humanitario tras la implementación del acuerdo de la paz. Por lo anterior, se ha tomado en consideración el uso de los mencionados artefactos en la historia reciente de su uso por los Grupos Armados al Margen de la Ley, precisamente a las antiguas FARCEP, sus zonas de acción militar y la imposibilidad para entregar zonas previamente delimitadas para realizar usos indebidos de estos artefactos e incumpliendo las convenciones internacionales (Ottawa) y el acuerdo final para la terminación del conflicto. Por último, se quiere indagar sobre el rol de la Justicia Especial para la Paz (JEP), su jurisdicción y las infracciones a los Derechos Humanos y el DIH
