PENERAPAN RESTORATIVE JUSTICE DALAM PENYELESAIAN KASUS KECELAKAAN LALU LINTAS MENGAKIBATKAN MATINYA ORANG OLEH ANAK (Studi Kasus di Wilayah Hukum Kepolisian Resor Pasuruan)

ABSTRACTThis research is motivated by the many cases of traffic accidents by children with imprisonment sanctions that have a negative impact on children. The problem raised is the application of restorative justice in resolving cases of traffic accidents that result in the death of people by children in the jurisdiction of the Pasuruan Resort Police, along with obstacles and efforts. Empirical juridical research with sociological approach and legislation approach. The results of this study are the Unit Gakkum Satlantas Polres Pasuruan implement restorative justice in cases of traffic accidents that resulted in the death of people through diversion. Barriers experienced: there is no clear rule of law, difficulty in getting approval from the victim's family, pre-diversion takes a long time, legal awareness is still low and intervention from the community. Efforts to overcome these obstacles: form special regulations, provide understanding to the families of victims regarding the restorative justice settlement process, the Police coordinate with other agencies, conduct socialization and counseling, and the Police act as mediators in the diversion process.Keywords: Restorative Justice, Traffic Accident, Child, Death Person ABSTRAKSkripsi ini dilatarbelakangi banyaknya kasus kecelakaan lalu lintas oleh anak dengan sanksi pidana penjara yang menimbulkan dampak negatif bagi anak. Adapun permasalahan yang diangkat adalah penerapan restorative justice dalam penyelesaian kasus kecelakaan lalu lintas yang mengakibatkan matinya orang oleh anak di wilayah hukum Kepolisian Resor Pasuruan, beserta hambatan dan upaya. Penelitian yuridis empiris dengan metode pendekatan sosiologis dan pendekatan peraturan perundang-undangan. Hasil dari penelitian ini adalah Unit Gakkum Satlantas Polres Pasuruan menerapkan restorative justice pada kasus kecelakaan lalu lintas yang mengakibatkan matinya orang melalui diversi. Hambatan yang dialami: tidak ada aturan hukum yang jelas, sulitnya mendapat persetujuan dari pihak keluarga korban, pra diversi membutuhkan waktu lama, kesadaran hukum masih rendah dan intervensi dari masyarakat. Upaya untuk mengatasi hambatan tersebut: membentuk peraturan khusus, memberikan pemahaman kepada keluarga korban terkait proses penyelesaian secara restorative justice, Kepolisian berkoordinasi dengan instansi lain, melakukan sosialisasi dan penyuluhan, serta Kepolisian menjadi penengah dalam proses diversi.
