Obstáculos epistemológicos no processo de ensino jurídico

The importance of the issue of “epistemological obstacles in the teaching process of law” is, one, the vast expansion of faculties of law that occurs in Brazil and, consequently, the urgency of which there are more efficient ways of transmission of legal knowledge So that they can make real lawyers; two, to, increasingly common, there are students seeking seats in a second graduation from college, in the course of law, so that these “veterans”, even though Bring the empirical knowledge of the law, not make them an obstacle to his knowledge search for new knowledge. There was this work dividing it into three stages. At first it presents, in summary form, the epistemology of Gaston Bachelard, bringing up the concepts necessary for understanding by the reader of matter dealt with here, then sets out various epistemological obstacles identified by Bachelard, which contribute negatively in progress the knowledge and, finally, are suggested ways of overcoming the obstacles that hinder the legal knowledge, alerting the teachers of this area in order to seek better know their students so as to identify the obstacles in your classroom, overcome - them and give their orientandos the real legal expertise. The teaching process of law.A importância do tema “Obstáculos epistemológicos no processo de ensino do Direito” deve-se, primeiramente, à grande expansão de faculdades de Direito que ocorre no Brasil e, em conseqüência, à urgência de que se observem maneiras mais eficientes de transmissão dos conhecimentos jurídicos, de forma a que se possam formar verdadeiros juristas; depois, a, cada vez mais comum, existência de estudantes que buscam, nos bancos das faculdades, uma segunda graduação, de maneira a que estes “veteranos”, ainda que tragam os conhecimentos empíricos do direito, não tornem estes saberes um empecilho à sua busca de novos conhecimentos. Procedeu-se a este artigo, dividindo-o em três etapas. De início apresenta-se, de forma sucinta, a epistemologia de Gaston Bachelard, trazendo-se os conceitos necessários ao entendimento pelo leitor da matéria aqui tratada; em seguida, apresentam-se diversos obstáculos epistemológicos, identificados por Bachelard, que contribuem negativamente no progresso do conhecimento; e, finalmente, sugerem-se formas de superação dos obstáculos que entravam o conhecimento jurídico, alertando os professores desta área, no sentido de procurarem conhecer melhor os seus alunos, de maneira a identificar os obstáculos existentes em sua sala de aula, superá-los e proporcionar aos seus orientandos o verdadeiro conhecimento jurídico.
