PT. GoTo Gojek Tokopedia must manage occupational safety and health (K3) for its drivers well, the driver as one of the spearheads of the company in running some of its products, the driver is very at risk of having a work accident, with this risk PT. GoTo Gojek Tokopedia must carry out management in the aspect of safety and good occupational health (K3) in accordance with the Decree of the Minister of Manpower Number 5 of 1996 concerning Manpower Management. As for in this study, the main problems to be discussed are Occupational Safety Protection (K3) for Gojek drivers at PT. GoTo Gojek Tokopedia Pekanbaru Branch and the second Barriers to Occupational Safety and Health Protection (K3) for Gojek Drivers at PT. GoTo Gojek Tokopedia Pekanbaru Branch. And the purpose of this study is the same as the formulation of the main problem, namely to find out the results of the formulation of the problem made by the researcher. This legal research belongs to the type of survey research (Observational Research). This type of research method is intended to solve problems that exist at the present time by collecting data and compiling or clarifying it, then analyzing and seeing a legal reality in society to then obtain a result. The results of the research that the authors obtained are: the initial agreement between the company and partners or between PT.GoTo Gojek Tokopedia Pekanbaru Branch, in accordance with the gojek partner agreement the company is not responsible for accidents but in this case the company requires the drivers to register themselves as members BPJS Employment to overcome accidents and illness if experienced by drivers. The company's obstacle in carrying out Occupational Safety and Health protection for drivers is that there are drivers who have not registered as members of the BPJS Employment, so the Company always educates each driver to be obliged to use BPJS Employment as a form of protection in the event of an accident.
