Tinjauan Yuridis Terhadap Kewenangan Mahkamah Konstitusi Sebagai Pembuat Norma Hukum Baru

This research is normative research, taking into account and referring to the laws and regulations and decisions of the relevant Constitutional Court. The question examined is: First, is the Constitutional Court authorized to make decisions that are positive legislatures? Second, how does the Constitutional Court's decision compare positive legislature and negative legislature in Decree No.102/PUUVII/2009, Decision No.4/PUU-VII/2009, Ruling No.110-111-112-113/PUUVII/2009 and Verdict No.46/PUU-XIV/2016? The results showed that: a. The Constitutional Court is normatively not authorized to issue rulings of a positive nature (positive legislature). But on the basis of efforts to bring substantive justice to the community, then in some of its rulings the Constitutional Court Judges felt the need to make a legal breakthrough. b. The reasons and considerations of the Constitutional Court Judges in Decree No.102/PUU-VII/2009, Decision No.4/PUU-VII/2009, and Decision No.110-111-112-113/PUU-VII/2009 are the existence of legal vacancies and urgent times, and the Constitutional Court further demonstrates the usefulness of law and justice. However, the Constitutional Court in Decree No.46 / PUU-XIV / 2016 prioritizes aspects of legal certainty solely at the expense of justice and expediency
