Una aproximacion a Levinas y los derechos humanos (o como la postmodernidad puede sorprendernos)

The article investigates the possibilities of an ethical foundation for Human Rights on the basis of the thinking of Emmanuel Lévinas thought. Levinas’ new ethical proposal makes it possible to develop a new foundation for Human Rights, which are no longer grounded on the essential ontological constitution of humankind, but on a new philosophy of otherness, which constitutes an asymmetrical movement which goes from the self to the other and never from the other to the self. Starting from these premises, the idea of human community is established by the language between brothers, in which fraternity as an inter-subjective phenomenon caused by the irruption of the other in being implies to situate metaphysics on the social level. Finally, the paper points out the need of approximation between human beings and, as a consequence, the idea of equality as a fundamental pillar of justice. Key words: foundation of Human Rights, ethics, otherness.El texto investiga las posibilidades de una fundamentación ética de los derechos humanos, basándose en el pensamiento del filósofo lituano Emmanuel Lévinas. La nueva propuesta ética de Lévinas permite una re-fundamentación de los derechos humanos, no ya basados en la constitución ontológica esencial del hombre, sino que apoyada sobre la base de una inédita filosofía de la alteridad que se constituye en un movimiento asimétrico que siempre va desde el yo al otro y nunca desde el otro hacia el yo. Partiendo de esas premisas, la idea de comunidad humana se instaura por el lenguaje entre hermanos, en la cual la fraternidad como fenómeno intersubjetivo inaugurado por la irrupción del otro en el ser implica situar la metafísica en el plano de lo social. Finalmente, senãla la necesidad de aproximación entre los seres humanos y, por consiguiente, la idea de igualdad como pilar fundamental de la justicia.
