STATUS ANAK PERNIKAHAN SIRRI DITINJAU DARI HUKUM POSITIF DI INDONESIA

Marriage aims to form a happy family and also another goal that is eternal. In marriage it is necessary to inculcate that marriage lasts for a lifetime and is forever separated only by death. The purpose of marriage according to Islam is to obey Allah's commands to obtain legitimate offspring in society, by establishing a peaceful and orderly household. in order to obtain legal force, for the benefit of, as well as to prevent the possible negative impacts caused by the marriage, normatively every marriage needs to be carried out before and under the supervision of the marriage registrar. The illegitimacy of an underhand marriage without according to state law also has a negative impact on the status of a child born who is considered an illegitimate child; the child only has a civil relationship with the mother and the mother's family. This paper mainly discussed about the status of children from sirri marriages in terms of national positive law and the legal protections for children born from Sirri's marriage.
