L'articolo si propone di stabilire se i soggetti discriminati in ragione della loro et\ue0 rappresentino una minoranza "invisibile" oppure una categoria di persone adeguatamente tutelata dal diritto dell'Unione europea. A tal fine, il lavoro individua le fonti dell'ordinamento comunitario che fissano un divieto di discriminazioni in base all'et\ue0 ed esamina la giurisprudenza della Corte di giustizia che interpreta tali fonti. L'articolo dimostra che il diritto dell'Unione ha consentito di operare un efficace contrasto a questo tipo di discriminazioni, attraverso un sindacato ben strutturato delle normative nazionali che, in materia di rapporti di lavoro, introducono disparit\ue0 di trattamento basate sul criterio anagrafico
