Arts 8:101-8:103

The contribution, following the general approach of the book, analyses Arts 8:101 to 8:103 of the European Principles of Contract Law (PECL) and compares them to Italian law (including uniform law such as CISG). The conclusion is reached that the PECL general provisions on non-performance are basically compatible with the Italian legal system and have the advantage of better clarifying the rules of the law in action.
