L'imperatore Costantino e la legge

The study focuses on ‘law’ as guarantee of the social life, that, according to the age taken into account, finds its own legitimacy in different authorities (human, divine, natural, rational, constitutional, etc.). The intertwinement between the ‘force’ of the political power and the effectiveness of the rules – as well as it is fulfilled in the Nation-State system, in which law is the producer of juridical rules par excellence – is now in crisis. Furthermore it is pressed by the globalization, that calls into question the foundation of the system itself: the sovereignty of the State. In the present system of the sources of the law, the national law has to compete every day with the supranational rules of the European Community and with the international treaties not being sufficient to complete the juridical phenomenon by itself anymore. The main theme is the historicity of the juridical fact, with its non-definitive perspective of the conceptual mould, which, in particular, refuses an absolute concept of law. The point is to show how law, also within other juridical experiences such as the ancient Roman law, had been modified becoming the only way to make juridical rules, while before it was just ‘one’ of the possible ways. The purpose is not so much the comparison with the present juridical position, too remote from the Roman one, but rather the awareness of the relativism of the ordering models which, if studied in connection with the social complex, that is their own experience, may be useful to understand the juridical phenomenon. Si propone una riflessione sulla ‘legge’, quale garanzia del vivere sociale, che, a seconda delle epoche storiche considerate, trova la propria legittimazione in fonti autoritative diverse (umane, divine, naturali, razionali, costituzionali, etc.). L’immagine dell’intreccio tra la ‘forza’ del potere e la ‘efficacia’ delle norme, così come si è risolta nel sistema dello Stato-nazione che ha fatto della legge il modo di produzione del diritto per eccellenza, è oggi in crisi, incalzata dal fenomeno della ‘globalizzazione’, che mette in discussione il cardine del sistema: la sovranità dello Stato. Nell’attuale sistema delle fonti del diritto, la legge nazionale è costretta a misurarsi, quotidianamente, con le regole sovrannazionali della Comunità europea e dei trattati internazionali, non esaurendo più in se stessa il dato normativo. L’oggetto, su cui si richiama l’attenzione, è la storicità del giuridico, con la sua visione non definitiva degli schemi concettuali, che, nello specifico, significa il rifiuto del concetto assoluto di legge. Si vuole dimostrare come l’immagine della legge, anche ricondotta ad altre esperienze giuridiche, quali quella risalente al lontano passato del diritto romano, abbia subito modificazioni, passando da uno all’unico dei modi di produzione del diritto. L’intento non è di evidenziare le possibili similitudini con la situazione giuridica attuale, troppo lontana da quella romana, quanto invece avere consapevolezza del relativismo degli schemi ordinanti, che, se studiati in relazione alla formazione sociale, cioè alla loro esperienza, possono rivelarsi utili alla comprensione del fenomeno giuridico.
