This article aims to present a theoretical reflection on the critical perspective of human rights. It comprises the epistemological and political approaches, as well as the relevant authors, who contribute to the constitution of this perspective on the analysis of Human Rights; also, the central category in the approach to the processes of education in human rights and memory in societies affected by the armed conflict and restricted democracy, as has been the case in Chile and Colombia. This reflection is relevant to understand that, when referring to the category of human rights, it is essential to show from which theoretical and ideological corner it is addressed.
