The Role of Community Justice in the Process of Peacebuilding in Colombia

La Constitución Política de 1991 incorporó mecanismos de justicia comunitaria para fomentar el acceso efectivo a la justicia de poblaciones marginadas y excluidas, debido a las múltiples vicisitudes del sistema de administración de justicia. El contexto actual de transición política y construcción de paz del Estado colombiano presenta un escenario de emergencia para la justicia comunitaria, lo cual implica realizar una lectura de esta como un mecanismo híbrido capaz de contribuir al acceso a la justicia y de servir como herramienta clave en la edificación de la paz y como catalizadora del posconflicto. Especialmente en zonas de caos, donde se encuentran vacíos de poder dejados por la desmovilización de las FARC-EP, existe un cúmulo de necesidades jurídicas insatisfechas y proliferan los conflictos y la violencia. Allí, la justicia comunitaria cuenta con la virtud de instaurar una cultura de paz y de derechos humanos por medio de una solución creativa, no violenta, y de un enfoque positivo y transformador de los conflictos. Asimismo, desde la articulación de esta institución a las agendas políticas de implementación de los puntos del Acuerdo de Paz, como por ejemplo la Reforma Rural Integral (RRI) y el Programa Nacional Integral de Sustitución de Uso de Cultivos de Uso Ilícito (PNIS), desde donde es posible apalancar procesos locales de implementación que permitan su anclaje y sostenibilidad en los territorios.The 1991 Political Constitution established community justice as a mechanism of affective access to justice for marginalized and excluded populations, due to the multiple vicissitudes of the justice administration system. The current context of political transition and peace-building in the Colombian State offers an emergency scenario for community justice, which implies reading it as a hybrid mechanism capable of contributing both to access to justice and as a key tool in the construction of Peace and a catalyst for the postconflict, especially in areas of chaos where there are power vacuums left by the demobilization of the fa rc-ep, there is a high accumulation of unsatisfied legal needs, conflicts and violence proliferate. From there, community justice has the virtue of establishing a culture of peace and human rights through a creative, non-violent solution and a positive and transformative approach to conflicts. Likewise, from the articulation of this institution to the political agendas for the implementation of the points of the Peace Agreement, in relation to the implementation of such complex issues as the Comprehensive Rural Reform and the National Program for the Substitution of Illicit Use, from where it is possible to leverage local implementation processes that allow their anchoring and sustainability in the territories
